The use of outdoor wood-fired heating or energy source devices in Dickinson Township is permitted subject to the following conditions and requirements.
A. 
Burning is restricted solely to dry, clean wood, and the burning of other matter is prohibited. Such burning shall not include, contain or be composed of any prohibited materials. During the entire period of use, every owner and user of an outdoor wood-fired heating or energy source device shall have a current contract with a licensed solid waste hauler and shall use its services for disposal of all household solid waste including, but not limited to trash, debris and garbage. Upon request, every owner and user of an outdoor wood-fired heating or energy source device shall present proof of a current waste disposal contract to the Township or authorized enforcement agency.
B. 
Outdoor wood-fired heating or energy source devices are not permitted in the B-R Business Recreation, B-I Business Industrial and MDR-O Medium-Density Residential Office zoning districts.
C. 
Outdoor wood-fired heating or energy source devices must be set back at least 200 feet from the front lot line and 100 feet from the side and rear lot lines and 500 feet from the nearest residential structure not on the lot where the outdoor wood-fired heating or energy source device is located.
D. 
Outdoor wood-fired heating or energy source devices must be equipped with a properly functioning spark arrestor.
E. 
Lighter fluids, gasoline and chemicals to start the outdoor wood-fired heating or energy source device are prohibited.
F. 
Installation, use and operation must comply with all applicable local, state and/or federal laws, regulations and guidelines as well as applicable building and other codes of the Township.
G. 
All outdoor wood-fired heating or energy source devices must qualify for the United States Environmental Protection Agency (EPA) Phase 2 classification, or successor EPA technical standards, at the time of installation.
H. 
The use of outdoor wood-fired heating or energy source devices shall be limited to the period from September 15 to May 15.
I. 
Stack height shall be in accordance with the outdoor wood-fired heating or energy source device manufacturer's specifications.
J. 
The use of the outdoor wood-fired heating or energy source device shall not cause a nuisance to the occupants of other property.
K. 
Any outdoor wood-fired heating or energy source device installed and in use prior to the effective date of this article shall be permitted to remain in its present location and continue to be used provided the owner shall fully comply with all of the following provisions:
(1) 
The owner of such outdoor wood-fired heating or energy source device shall register the device with the Township Zoning and Code Enforcement Officer within 60 days of the effective date of this chapter. Registration shall not be complete unless all information requested in the registration form has been timely provided. No fee shall be imposed for the registration of such device. The use of any such device not so registered shall be discontinued and the device shall be promptly removed from the property.
(2) 
The use of such device, except for placement location and manufacturer specifications, shall otherwise comply with all remaining provisions of this chapter, any amendments thereto, and with all applicable local, state or federal laws or regulations.
(3) 
Upon the expiration of the useful life of such device, but in no event later than 30 years from the effective date of this article, the use of such device shall be discontinued and the device shall be removed from the property; provided, nothing herein shall be construed to prohibit the installation or use of an outdoor wood-fired heating or energy source device which fully complies with the provisions of this chapter, any amendments thereto, and with all applicable local, state or federal laws or regulations.
