The office of Director of Public Safety, established by resolution of the Board February 16, 1988, is hereby abolished, and the responsibilities, duties and functions of that office are hereby transferred to the Commissioner.

The powers vested generally in the Deputy Mayor to act in the absence of the Mayor shall not include those powers and duties vested in the Mayor as Commissioner except as specified in this section. In the absence of the Commissioner, the powers and duties of the Commissioner as head and principal executive officer of the Department shall be vested in the Deputy Commissioner of the Department. In the absence of both the Commissioner and the Deputy Commissioner, the Deputy Mayor shall be vested with all the powers of the Commissioner and may perform all of the Commissioner's duties.
Upon the date this chapter becomes effective, the list of Village officers authorized to issue appearance tickets pursuant to § 3-1 of the Code shall be amended to include the Deputy duly appointed pursuant this chapter, and the title "Director of Public Safety" shall be deleted therefrom.[1]

It is the intent of the Board that the provisions of § 24-11 of this Article IV shall supersede the provisions of Village Law § 4-400, Subdivision 1h.
