No person, firm or corporation in the Village of Woodville shall, in any manner, directly or indirectly, upon any premises, or by any device, sell, exchange, barter, dispose of or give away, or keep for sale, any cigarette, cigarette paper or cigarette wrappers, or any substitute therefor, without first obtaining a license as hereinafter provided.
Every person, firm or corporation desiring a license under this article shall file with the Village Clerk-Treasurer a written application therefor on the prescribed form, stating the name of the person and the place for which such license is desired. Each license shall be filed by the Village Clerk-Treasurer and shall name the licensee and the place wherein he is authorized to conduct such business, and the same shall not be delivered until the applicant shall pay to the Village Clerk-Treasurer a license fee as set by the Village Board.

Licenses for the sale, exchange, barter, disposition of, or giving away or keeping for sale of any cigarette, cigarette paper or cigarette wrappers or any substitute therefor shall be issued by the Village Clerk-Treasurer. Each license shall be issued on the first day of July in each year, or thereafter whenever applied for, and shall continue in force from the date of issuance until the succeeding June 30 unless sooner revoked for any violation of this article.

The provisions of § 101.123, Wis. Stats., as amended by 2009 Act 12, relating to the regulation of smoking and clean indoor air, except provisions therein relating to penalties to be imposed, are hereby adopted by reference and made part of this article as if fully set forth herein. Any act required to be performed or prohibited by such statute incorporated herein by reference is required or prohibited by this article. Any future amendments, revisions or modifications of the statute incorporated herein are intended to be made a part of this article. Penalties for violation shall be as provided in § 244-6. As prescribed by § 101.123(8)(dm), Wis. Stats., a warning notice shall be issued to the person in charge for the first violation.
In recognition of a need to protect the health and comfort of the public and Village employees from the detrimental effects of smoking, pursuant to the authority granted to the Village by § 101.123(4m), Wis. Stats., smoking, as defined by § 101.123(1)(h), Wis. Stats., is hereby prohibited by any person within or upon all buildings and enclosed equipment owned, leased or rented by the Village of Woodville, except in designated areas.
The forfeiture for a violation of the provisions of § 244-4 of this article relating to the prohibition of smoking in various enclosed places shall be $100 for each violation, except that the forfeiture for a person in charge cannot exceed $100 per day.
