No person shall impede the progress of a fire engine, fire truck
or other fire apparatus of the United Fire and Rescue District along
the streets or alleys of such Village at the time of a fire or when
the United Fire and Rescue District is using such streets or alleys
in response to a fire alarm or for practice.

A.
Police authority at fires.
(1)
The incident commander and assistants or officers in command at any
fire are hereby vested with full and complete police authority at
fires. Any officer of the United Fire and Rescue District may cause
the arrest of any person failing to give the right-of-way to the United
Fire and Rescue District in responding to a fire.
(2)
The incident commander may prescribe certain limits in the vicinity
of any fire within which no persons, excepting fire fighters and police
officers and those admitted by order of any officer of the United
Fire and Rescue District, shall be permitted to come.
(3)
The incident commander shall have the power to cause the removal
of any property whenever it shall become necessary for the preservation
of such property from fire or to prevent the spreading of fire or
to protect the adjoining property, and during the progress of any
fire he shall have the power to cause the removal of all wires or
other facilities and the turning off of all electricity or other services
where the same impedes the work of the United Fire and Rescue District
during the progress of a fire.
B.
Fire inspection duties.

(1)
The incident commander, or his designee, shall be the Fire Inspector
of the Village of Woodville and shall have the power to appoint one
or more Deputy Fire Inspectors and shall perform all duties required
of fire inspectors by the laws of the state and rules of the Department
of Safety and Professional Services (formerly the Department of Commerce),
particularly § 101.14, Wis. Stats.
(2)
While acting as Fire Inspector pursuant to § 101.14(2),
Wis. Stats., the incident commander, or any officer of the United
Fire and Rescue District designated by the Village Board, shall have
the right and authority to enter any building or upon any premises
in the Village of Woodville at all reasonable hours for the purpose
of making inspections or investigations which, under the provisions
of this Code, he may deem necessary. Should the Fire Inspector find
that any provisions of this Code relating to fire hazards and prevention
of fires are being violated or that a fire hazard exists which should
be eliminated, it shall be his duty to give such directions for the
abatement of such conditions as he shall deem necessary and, if such
directions are not complied with, to report such noncompliance to
the Village Board for further action.
(3)
The incident commander is required, by himself or by officers or
members of the United Fire and Rescue District designated by the Village
Board as Fire Inspectors, to inspect all buildings, premises and public
thoroughfares, except the interiors of private dwellings, for the
purpose of ascertaining and causing to be corrected any conditions
liable to cause fire, or any violations of any law or ordinance relating
to the fire hazard or to the prevention of fires. Such inspections
shall be made at least once in six months in all of the territory
served by the United Fire and Rescue District and not less than once
in three months in such territory as the Village Board has designated
or hereafter designates as within the Village or as a congested district
subject to conflagration, and more often as the incident commander
orders. Each six-month period shall begin on January 1 and July 1
and each three-month period on January 1, April 1, July 1 and October
1 of each year.
(4)
Written reports of inspections shall be made and kept on file in
the office of the United Fire and Rescue District in the manner and
form required by the Department of Safety and Professional Services
(formerly the Department of Commerce). A copy of such reports shall
be filed with the incident commander.
A.
Damaging or driving over fire hose. No person shall willfully injure
in any manner any hose, hydrant or fire apparatus belonging to the
United Fire and Rescue District and no vehicle shall be driven over
any unprotected hose of the United Fire and Rescue District when laid
down on any street, private driveway or other place to be used at
any fire or alarm of fire without the consent of the United Fire and
Rescue District official in command.
B.
Parking vehicles near hydrants. It shall be unlawful for any person
to park any vehicle or leave any object within 10 feet of any fire
hydrant at any time.
C.
No parking near fire. It shall be unlawful for any person, in case
of fire, to drive or park any vehicle within one block from the place
of fire without the consent and authority of the incident commander
or any police officer.
It shall be lawful for any fire fighter while acting under the
direction of the incident commander or any other officer in command
to enter upon the premises adjacent to or in the vicinity of a building
or other property then on fire for the purpose of extinguishing such
fire, and in case any person shall hinder, resist or obstruct any
fire fighter in the discharge of his duty as is hereinbefore provided,
the person so offending shall be deemed guilty of resisting fire fighters
in the discharge of their duty.
Whenever there shall be a fire or fire alarm or the United Fire
and Rescue District shall be out for practice, every person driving
or riding in a motorized or other vehicle shall move and remain to
the side of the street until the fire engine and fire truck and other
fire apparatus shall have passed.
No person shall occupy any portion of such streets or alleys
with a motorized or other vehicle between such fire engine or fire
truck or other fire apparatus and any hydrant to which a fire hose
may be or may be about to be attached.
A.
Open burning prohibited.
(1)
Prohibition. No person, firm or corporation shall build any outdoor
fire within the corporate limits of the Village of Woodville excepting
as set forth below in this section. This prohibition on burning includes
burning of construction waste and debris at construction sites.
(2)
Fire maintained in a building. The owner or occupant of any building or any person or corporation engaged either as a contractor, workman or in any other capacity in any work upon any building who or which maintains a fire in any building within this Village in a stove, salamander, or other similar contrivance without having some person at all times present in such building to attend such fire shall be subject to penalty as provided in § 1-4 of this Code, unless a fireproof substance is at all times maintained immediately under the same and unless the same is connected with the outside of the building by means of a noncombustible pipe or chimney in such manner that all of the smoke and gases arising from such fire are conducted directly to the outside of said building.
(3)
Fires prohibited. No person shall kindle or start a fire in the open air within the Village without the use of a burner, as regulated in Subsection A(4), except in approved burning areas or as otherwise hereinafter provided.
(4)
Cooking fires. Wood or other nonexplosive fuel may be burned for
the purpose of cooking or preparing foods, only under constant supervision,
not nearer than 10 feet to any building, in a substantial burner built
of metal, concrete or brick.
B.
Burning leaves, clippings or wood.
(1)
No person shall burn any wood, grass, leaves, rubbish or other combustible materials upon the streets or alleys in the Village at any time, except as provided in Subsection D of this section.
(2)
Except as otherwise provided in the Village ordinances, no person,
firm or corporation shall burn any wood upon any property in the Village.
(3)
Leaves and plant clippings may be burned on private property between
the hours of 2:00 p.m. and sunset during the period running from the
15th day of April through the first day of June and the period running
from the first day of October through the 15th day of November of
each year, unless a county burning ban is in effect.
(4)
At no time shall the smoke or heat created by such burning be an
annoyance or discomfort to the neighborhood or the traveling public.
C.
Transporting fire. No person shall carry, keep or maintain any fire
in, through or upon any public thoroughfare or premises, except within
an approved closed, secure pan, vessel or vehicle.
D.
Restrictions.
No person shall build or burn any bonfire or burn in the open any
wood, grass, trash, rubbish or other material or permit the same to
be done within the Village upon any street, court or alley or upon
or in any premises, unless such burning activity is within the following
exceptions:
(1)
Fires
set for practice and instruction of fire fighters.
(2)
Interior
fireplaces or woodburning stoves.
(3)
Charcoal
or gas grills used for noncommercial outdoor cooking.
(4)
Woodburning
portable outdoor fireplaces that are fully screened and covered.
(5)
Special
Village, school or church events involving outdoor cooking devices
and bonfires as recommended by the incident commander and approved
by the Village Board.
(6)
In-ground
fire pits no more than three feet in diameter (interior measurement
of the ring) which are surrounded with an enclosure of rock, brick,
cement block or a similar material. Such pits shall be located no
less than 15 feet from a property line and no less than 20 feet from
any structure. Any fire built in such a pit will be completely within
the enclosed area, and no combustible material shall extend onto or
outside of the enclosure.
E.
Supervision
and control. Any open burning shall be constantly attended by a competent
individual at least 16 years of age. No open fire shall be left burning
or smoldering unattended. Adequate materials for extinguishing any
open fire shall be readily available to the individual attending the
fire.

Individual property owners within the Village of Woodville receiving
firefighting and fire protection services will be charged a fee as
set by the United Fire and Rescue District, per call, for actual firefighting
and fire protection services provided to their individual property
plus any out-of-pocket expenses incurred for heavy equipment rented
from third parties, nondistrict personnel for handling hazardous substances,
etc. If a call is made to a vehicle located on a public road within
the Village of Woodville, the charges shall be imposed on all owners
of such vehicle.

A.
From and after the effective date of this section, each residence,
place of business, or other primary building structure within the
Village of Woodville shall be required to have assigned to it, from
and through the Village, a street identification number.
(2)
All
such identification numbers shall be at least three inches in height,
shall be of a contrasting color to the color of the surface to which
they are affixed and shall be visible from both directions from the
abutting public right-of-way. (Example: If the right-of-way runs north
and south, then the numbers must be visible from north of the mailbox
or signpost and south of the mailbox or signpost; on culs-de-sac,
the numbers must be visible from all angles.)
(3)
This section shall not prohibit the assigned numbers from being written
out in addition to the numerical numbers required above.
B.
Variances. The Village Board may grant variances from the terms of
this section if a property owner can demonstrate that a literal enforcement
of this section will be unduly burdensome or would defeat its purpose
and intent.

all of which are set forth in the Wisconsin Administrative Code as
from time to amended, are incorporated herein by reference and adopted
as part of this chapter:

A.
The Fire Chief shall hold the office of Fire Inspector, with power
to appoint one or more deputy fire inspectors who shall perform the
same duties and have the same powers as the Fire Inspector.
B.
Whenever or wherever in the Village any inspection by the Fire Chief
or their deputies reveals a fire hazard, the Chief or their deputies
shall serve notice, in writing, upon the owner of the property, giving
the owner a reasonable time in which to remove the hazard. If the
fire hazard is not removed within the time allowed, it shall be deemed
a nuisance. The Fire Chief or their deputy is authorized to have the
same removed by the Village, and the cost of such removal shall be
charged on the tax roll against the property.
C.
The Chief shall keep a written record card of each property inspected
which shall conform to the requirements of the Department of Commerce
and shall make the quarterly report of inspections required by the
Department of Commerce.
D.
No person shall deny the Chief or their deputies' free access to
any property within the Village at any reasonable time for the purpose
of making fire inspections. No person shall hinder or obstruct the
Fire Inspector in the performance of their duty or refuse to observe
any lawful direction given by them.
