§ 260-1 Adoption of standards. [1]

A certain document, three copies of which are on file in the office of the Municipal Clerk of the Borough of Westwood, being marked and designated as the "International Property Maintenance Code, 2009 Edition," as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Westwood, in the State of New Jersey, for regulating and governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; and providing for the issuance of permits and the collection of fees therefor. Each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Municipal Clerk of the Borough of Westwood are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 260-2 of this chapter.

§ 260-2 Amendments to standards.

The following sections are hereby revised:

A. Section 101.1: Insert "the Borough of Westwood."

B. Section 103.5, Fees, shall be amended to read as follows: "The fees for activities and services performed by the Department in carrying out its responsibilities under this code shall be as set forth in the Fee Ordinance for the Borough of Westwood as is adopted from time to time."

C. Section 302.4, Weeds, shall be amended to insert the height of 12 inches in line three thereof.

D. Section 304.14, Insect screens, shall be amended to eliminate the words "During the period from [date] to [date]" therefrom and to insert in its stead the words "At all times."

E. Section 602.3: Insert "October 1 through May 1."

F. Section 602.4: Insert "October 1 through May 1."

§ 260-3 Effect on pending litigation.

Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 260-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.

§ 260-4 Publication.

The Municipal Clerk is hereby ordered and directed to cause this chapter to be published as required by law.

§ 260-5 When effective.

This chapter and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect immediately upon publication after the date of its final passage and adoption.

§ 260-6 Violations and penalties. [1]

Any violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article III, General Penalty, of the Code of the Borough of Westwood.
