This article is ordained and enacted pursuant to the Intergovernmental Cooperation Act of December 19, 1996, P.L. 1158, No. 177, § 1 (53 Pa.C.S.A. § 2304),[1] whereby two or more local governments may jointly cooperate in the exercise of their respective governmental functions.

The Township of Derry is hereby authorized to enter into and execute that intergovernmental cooperation agreement, substantially in the form attached hereto as Exhibit "A" and incorporated herein by reference,[1] with the County of Mifflin, Pennsylvania, and thereby participate in that LED (light emitting diode) Traffic Signal Conversion Project initiated by SEDA-Council of Governments ("SEDA-COG") in partnership with PennDOT Districts 2 and 3, and whereby the County of Mifflin shall act as procurement agent to purchase from the selected lighting vendor LED lighting equipment as necessary to upgrade the Township's existing traffic signals to LED technology.

The Township of Derry agrees that it shall be responsible for the cost of any ancillary hardware necessary for proper installation of said traffic signal technology, all costs of installation, shall pay $3,842.54 to the county for purchase of the agreed and approved equipment, and shall otherwise be responsible for its own costs and expenses, all as set forth in said agreement.
Any actions taken or monies expended heretofore by the Township of Derry and its Supervisors, Manager/Secretary, Treasurer and its agents and employees is hereby ratified and confirmed.
The appropriate officers of the Township of Derry are hereby authorized to execute said agreement and any other documents necessary and appropriate to effectuate the intent of this article.
