A.
Words and phrases, when used in this chapter, have the meanings ascribed
to them in the Vehicle Code of Pennsylvania, as now in force or as
hereinafter amended, enacted and reenacted,[1] except where the context clearly indicates a different
meaning.

B.
LEGAL HOLIDAY
As used in this chapter, the following terms shall have the meanings
indicated:
New Year's Day, Memorial Day, Independence Day, Labor Day,
Thanksgiving Day and Christmas Day.
A.
The Mayor and/or Police Department have the following powers to regulate
traffic and parking temporarily and in time of emergency:
(1)
In the case of fire, flood, storm or other emergency, to establish
temporary traffic and/or parking regulations.
(2)
In the case of an emergency or to facilitate public works or in the
conduct of parades, processions or public events, to restrict or prohibit
traffic and/or parking in limited areas for periods of not more than
72 hours.
B.
Such temporary or emergency regulations shall be enforced by the
Mayor and the Police Department in the same manner as permanent regulations.
C.
Whoever operates or parks a vehicle or tractor in violation of any regulation established pursuant to the authority granted under this section or moves, removes, destroys, injures or defaces any sign or marking erected, posted or made to give notice of any such regulations shall be liable to the penalty set forth in the law or elsewhere in this chapter for violations of such nature and, in case of a violation for which no specific penalty is set forth in the law or elsewhere in this chapter, to the general code penalty provided under § 134-6.
The police officers of the Borough are hereby given authority
to direct traffic on the highways of the Borough and at intersections
thereof.
A.
The Police Department of the Borough of Masontown, Fayette County,
Pennsylvania, is hereby authorized to monitor, control and enforce
established speed restrictions and limits on streets and highways
located within the boundaries of the Borough of Masontown by use of
VASCAR and Excessive Speed Preventor (ESP) or such other electrical
speed-timing devices or any other speed-monitoring device now or as
may be hereafter authorized by the Pennsylvania Department of Transportation
and/or by statute for use by local authorities.
B.
Notice of the adoption of this chapter authorizing the use of electrical
speed-timing devices to monitor and enforce established speed restrictions
and limits shall be given to the public by the erection of signs on
streets and highways, as provided by law.
C.
The police officers using the devices authorized for use in Subsection A hereinabove shall be properly trained in the use and operation of said devices and certified to use and operate said devices in accordance with the regulations of the Pennsylvania Department of Transportation and as provided by law.
D.
Any and all ordinances heretofore enacted and ordained which are
inconsistent herewith are hereby repealed.
A.
No person, group of persons or organization shall conduct or participate
in any parade, procession or assemblage upon any highway or block
off any highway area without first obtaining a permit from the Mayor's
office.
B.
Applications for such permits shall be made on such forms as may
be prescribed and shall contain such information as is reasonably
necessary to a fair determination of whether a permit should be issued.
C.
Applications shall be filed not less than 10 days before the time
intended for such parade, procession or assemblage.
D.
The permit may be refused or canceled if the time, route and size
of the parade, procession or assemblage will disrupt to an unreasonable
extent the movement of traffic or would require the diversion of sufficient
police officers or firemen so as to deprive the Borough of normal
police and fire protection.
E.
The permit or any order accompanying it may be limited or prescribe
reasonable conditions, including the hours, the places of assembly
and of dispersal, the route of march or travel and the highways or
portions thereof which may be used or occupied.
Whoever violates any provision of this chapter for which no
other penalty is provided shall be fined not more than $10 and the
cost of prosecution.
