Police Department — See Ch. 25.
The Borough of Masontown shall enter into an intergovernmental police cooperation agreement ("agreement") with the City of Uniontown, City of Connellsville and German Township, under the terms of which the police officers of each municipality are granted authority to officially act as police officers of the other municipalities, subject to the terms of the agreement, when performing duties in the other municipalities, establishing procedures for the police department of each municipality to render aid and assistance to one another, such agreement to conform substantially to the agreement attached to and made a part of this ordinance as Exhibit A.
Editor's Note: The intergovernmental police cooperation agreement is on file in the office of the Borough Secretary and may be inspected there during regular business hours.
Further, the police officers of each municipality shall enter into a cooperation agreement with the Fayette County District Attorney's office, the terms of which shall provide that said police officers may be deputized as Special County Detectives and granted authority to officially act as police officers throughout the county.
Further, the police officers of each municipality shall enter into a cooperation agreement with the Pennsylvania Attorney General's office, the terms of which shall provide that said police officers may be deputized as special agents for the Bureau of Narcotic Investigation and Drug Control and shall have statewide jurisdiction to officially act as police officers through the state.
It is further provided that any other municipal, county or state agency may, upon mutual consent, enter into this cooperation agreement at a later date and time.
The duration of the agreement shall be indefinite, subject to termination by any municipality as provided in the agreement.
The purpose and objective of the agreement is to foster improved governmental cooperation between the Borough of Masontown and the City of Uniontown, the City of Connellsville and German Township and to improve law enforcement in the Borough of Masontown, City of Uniontown, City of Connellsville and German Township by providing police officers with the authority to exercise official duties in the other municipalities thereby alleviating problems of arrests being determined improper or unlawful by reason of jurisdictional or boundary issues.
Each municipality shall be responsible for all expenses incurred by reason of action taken by its police officers pursuant to the agreement, no other financing being necessary or required to effect its purpose.
No additional organizational structure will be necessary to implement the agreement, nor will any property, real or personal, be acquired, managed or disposed of in order to effect the purpose of the agreement.
The effectiveness of this ordinance is conditioned upon the City of Uniontown, the City of Connellsville and German Township executing the aforesaid agreement and enacting an ordinance implementing the agreement.
This action is taken pursuant to the authority granted the Borough of Masontown by the Intergovernmental Cooperation Act, Act of July 12, 1972, No. 180, § 1 et seq., 53 P.S. § 481 et seq., as amended.
All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
