A. 

It shall be the responsibility of every owner of property in the Borough of Duncannon, at his own expense, within 30 days after notice from the Borough Council so to do, to:

(1) 

Construct or reconstruct a sidewalk and/or curb, which shall conform to all applicable provisions of this article, in front of and/or alongside such property;

(2) 

Repair the sidewalk and/or curb, in the manner and to the extent stipulated in such notice, in front of and/or alongside such property.

B. 

Provided, the Borough Council shall have authority, at its own discretion, instead of requiring property owners to do the work of construction or reconstruction, or to have such work done, to enter into contracts, after proper advertisement and bidding, for construction and/or reconstruction of sidewalks and/or curbs in the Borough or any part thereof, and where this alternative shall be taken by the Council, the cost and expense of such work shall be recovered by the Borough from the abutting property owners.

A. 

The sidewalks on each side of the various streets in the Borough shall be paved to a width of four feet, with the following exceptions:

(1) 

Where walks shall have been lawfully paved to a greater or lesser width prior to the enactment of this article, such width shall remain the official width of such walks;

(2) 

Where a four-foot walk in any specific location shall be determined impracticable by the Borough Council, the Council shall either require a wider walk or allow a narrower walk, and in each instance shall fix the precise width to be paved, which shall be adhered to in construction of the walk.

B. 

Provided, in fixing widths of walks in such special cases, the Council may require alignment with walks abutting upon adjacent properties and may require an unpaved grassplot between the outer edge of the paved walk and the street or curb.

C. 

Provided, further, that no sidewalk shall be required along any portion of any street or alley where there shall not at this time be a sidewalk, until the Borough Council shall specifically order a sidewalk thereon.

D. 

Provided, further, that the owner of every corner lot shall pave sufficiently far beyond the corner of his lot to join with the pavement on the intersecting street.

All sidewalks and curbs in the Borough, hereafter constructed or reconstructed, shall be constructed or reconstructed, as the case may be, only of concrete, in conformity with the specifications adopted from time to time by the Borough Council. All sidewalks and curbs hereafter repaired shall be repaired of concrete, unless the existing sidewalk was heretofore lawfully constructed of material other than concrete, in which case repairs may be made of the material of which such walk was originally constructed. The Borough Manager, however, is hereby authorized to determine, in the case of any such walk previously constructed of material other than concrete, whether the state of such walk is such as to allow for a mere repair, or whether complete reconstruction shall be necessary, in which latter case, concrete shall be required.

All sidewalks and curbs shall be constructed, reconstructed and repaired in strict conformity with the official lines and grades established by the Borough therefor, and all sidewalks shall have a rise from the curb toward the building line at the rate of 2/5 of an inch to the foot.

Any property owner, upon his own initiative, and without notice from any Borough authority, may construct, reconstruct or repair a sidewalk in front of or alongside his property, but such owner shall first make application to the Borough Manager for the width, line and grade thereof, and, in such work of construction, reconstruction and repair, such property owner shall conform to such width, line and grade and to all other provisions of this article that would have applied had such work been done following notice from the Borough so to do.

The property owner shall be responsible, when any sidewalk or curb shall be constructed, reconstructed or repaired in front of or alongside his property, except under contract of the Borough, for erecting or placing barricades, warning signs and/or warning lights as necessary for the protection of the traveling public.

Upon the neglect of any property owner to comply with any requirements of this article or of any notice issued by the Borough thereunder, the Borough shall have authority, after notice to such delinquent property owner, to cause such work of construction, reconstruction and/or repair to be done, or to rectify any such work not done in conformity with the requirements of this article or of the notice issued by the Borough, and to collect the cost of such work, with an additional amount of 10% from such owner, in any manner authorized by law.
