As used in this article, the following terms shall have the meanings indicated:
MINOR
Any person under the legal age to purchase alcoholic beverages.
No minor shall purchase, attempt to purchase or have another purchase for him/her any alcoholic beverage on any premises licensed for the sale of alcoholic beverages.
No person shall purchase or attempt to purchase alcoholic beverages for a minor. It shall be unlawful for any person to induce or attempt to induce any licensee or any employee of a licensee to sell, serve or deliver alcoholic beverages to a minor.
No person shall misrepresent his/her age or the age of another person for the purpose of inducing any licensee, or his/her employee, to serve a person under the legal age in violation of this section.
Any adult who accompanies a minor into premises in which alcoholic beverages are served and who permits the minor to possess or consume alcoholic beverages shall be presumed to have misrepresented the age of the minor.
A. 
Any person under the legal age to purchase alcoholic beverages who knowingly possesses or consumes any alcoholic beverage in or on any school property, public conveyance, public place, or place of public assembly, or on private property shall be in violation of this subsection, and shall be subject to a fine of $50 to $250 and/or community service, and if considered necessary, reference to an alcohol treatment program at the defendant's expense.
B. 
This section shall not apply to persons under the legal age to purchase alcoholic beverages who possess or consume alcoholic beverages in the presence of and with the permission of the parent or legal guardian of the person, providing that the guardian is of the legal age to purchase alcoholic beverages, or if alcoholic beverage is being consumed in any religious observance, ceremony or rite.
A. 
Any person who shall be convicted of a violation of a provision of this section shall, upon conviction, be liable to the penalty stated in Chapter 1, General Provisions, Article III, General Penalty, as such court in its discretion may impose.
B. 
Statutory penalty. Any person who shall violate any of the provisions of this subsection shall be deemed and adjudged to be a disorderly person, and upon conviction thereof, shall be punished by a fine of not less than $100. In addition, the court shall suspend the person's license to operate a motor vehicle for six months or prohibit the person from obtaining a license to operate a motor vehicle in this state for six months beginning on a date he/she becomes eligible to obtain a license or on the date of conviction, whichever is later. In addition to the general penalty prescribed for an offense, the court may require any person under the legal age to purchase alcoholic beverages who violates this act to participate in an alcohol education for treatment program authorized by the Department of Health and Senior Services for a period not to exceed the maximum period of confinement prescribed by law for the offense for which the individual has been convicted.
