Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the New Jersey Statutes shall be deemed to apply to such words and
phrases used herein.
Whenever certain hours are named in this chapter, they shall
mean either Eastern standard time or Eastern daylight saving time
as may be in current use.
Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any police officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.
When, in the interest of public safety, the Chief of Police
or his/her designee shall deem it necessary and appropriate to temporarily
close streets and thoroughfares, in connection with public celebrations,
emergencies, calamities, road construction and the like, the governing
body reposes in the Chief of Police the authority to take such action,
provided that the action to be taken is necessary to protect and promote
the health, safety and welfare of the residents of the Township, and
provided that the emergency action taken hereunder shall end upon
the passing of the condition or circumstance necessitating same.
Unless another penalty is expressly provided by New Jersey statute or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall, upon conviction thereof, be liable to the penalty stated in Chapter
1, Article
III, General Penalty.
All former traffic ordinances of the Township of Clark which
are contained in this chapter are hereby repealed, and all ordinances
or parts of ordinances in conflict with or inconsistent with the provisions
of this chapter are hereby repealed, except that this repeal shall
not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this chapter.
