No persons, group of persons, corporations or other entities may operate a kennel in the City of Pawtucket without first obtaining a license from the Pawtucket City Council.
A. 
A certificate of zoning compliance must be received at the time of application.
B. 
Application shall include owner's name, location of establishment, and number of animals to be kept and any other information required by the City Council.
C. 
All applicants must meet all of the special use permit requirements for a pet care services establishment, as listed in § 410-60 of the Zoning Ordinance of the City of Pawtucket.
Upon receipt of an application for a license under this article, the City Clerk shall cause notice of the application for a kennel license to be published in a newspaper of general circulation in the City at least once, one week prior to the hearing date on such application. Such notice shall state the name of the applicant, the type of license requested and a description of the particular location for which the license is requested. Such notice shall also state that remonstrants are entitled to be heard before the granting of such license and shall name the time and place of the hearing. Furthermore, in the case of an initial license application, the City Clerk shall give similar notice by regular mail at least one week prior to the hearing to the owners of all property within 350 feet of the perimeter of the premises on which a kennel is sought to be located.
Each applicant for a kennel license shall pay to the City Clerk, upon filing the application, the license fee of $150, and shall also pay a nonrefundable filing fee to pay the expenses of the notice to be given by the City Clerk as above specified.
A. 
Licenses issued under the provisions of this chapter shall not be transferable.
B. 
All licenses under this chapter must be approved by the Animal Control Officer prior to issuance of City license.
C. 
State kennel license must be obtained prior to issuance of City license.
D. 
Every kennel licensee shall display his or her current license in a conspicuous place within his or her establishment.
E. 
Animal Control Officers shall be allowed to inspect all licensed properties at any time for compliance with state and local laws.
F. 
Any animal in the kennel must have an up-to-date rabies vaccination. DHLPP (or DA2PP) and Bordatella vaccinations, and must be licensed by the city or town where the owner lives and/or the dog is kept, if applicable.
G. 
Prior to issuance of license, certificate of liability insurance in the amount of at least $500,000 per occurrence covering any damage or injury which may be caused during the twelve-month period covered by the license. The policy shall contain a provision requiring the insurance company to provide written notice to the City Clerk of Pawtucket not less than 15 days prior to any termination of the policy and not less than five days subsequent to cancellation or expiration of the policy.
H. 
A kennel may hold up to the number of animals authorized by the Rhode Island Department of Environmental Management or any subsequent state regulating agency.

I. 
No kennel may hold animals currently prohibited in the City of Pawtucket.
J. 
Licensees must notify the Animal Control Officer of any and all animal bite incidents within 24 hours of each occurrence pursuant to the RI Rabies Control Board's Rules and Regulations governing the suppression of rabies.
K. 
All licensees must comply with all City ordinances pertaining to animals and noise.
L. 
No licensee shall maintain his or her kennel in such a manner that it creates a public nuisance or creates an unsafe/inhumane environment for the animals or humans.
M. 
No animals are to be boarded outdoors.
N. 
No outside exercising between the hours of 8:00 p.m. and 8:00 a.m.
Every such license shall be for a period of one year and expire on the first day of April next following the date thereof.
A. 
The raising or breeding of any animals is prohibited in the City by the Pawtucket Zoning Ordinance.
B. 
No licensee under this chapter may be in the business of buying or selling/adoption/re-homing animals.
A. 
Any person who violates § 116-61A of Article X of this chapter shall be subject to fines as enumerated in § 410-101.
B. 
Any person who violates any other sections of Chapter 19 of Title 4 of the General Laws of the State of Rhode Island may be subject to a suspension or revocation of his or her license and/or criminal prosecution pursuant to RI General Laws §§ 4-19-9 and 4-19-11.3.
