The Department of Urban and Economic Development is created.

(a) The head of the Department of Urban and Economic Development is the
Commissioner of Urban and Economic Development. The Commissioner is
appointed by the Mayor at such compensation as shall be approved by
the Board of Estimate and Apportionment as provided by law and serves
at the Mayor's pleasure.
(b) Except as otherwise provided by law, the Commissioner may appoint
subordinate administrators, engineers, stenographers, clerks and other
employees as necessary for performance of the Commissioner's duties,
at such compensation as shall be approved by the Board of Estimate
and Apportionment as provided by law. The Commissioner may organize
the Department into bureaus, agencies, offices or other subdivisions
appropriate to most efficiently carry out the Commissioner's duties,
subject to the approval of the Board of Estimate and Apportionment.
The Commissioner may oversee and control the operation and budget
of these various subordinate agencies and may adopt rules and regulations
by memo, letter or otherwise to implement the powers granted in this
division.
(c) The Commissioner, on behalf of the Department shall:
(1)
Advise the Mayor and the Common Council on all matters affecting
the physical growth and development of the City when requested or
required to do so.
(2)
Issue or delegate the responsibility to subordinate officers
to issue all permits, certificates, orders and notification resulting
from decisions on the ordinances administered by the Department.
(3)
Coordinate physical inspections made by the Department.
(4)
Serve as secretary to the Planning Board and be the official
custodian of its records.
(5)
Serve as secretary to the Zoning Board of Appeals and be the
official custodian of its records.
(6)
Establish liaison and close working relationships with the administrative
offices of the City and other governmental agencies and institutions
in order for plans of the area to be coordinated.
(7)
Promote the realization of the comprehensive plan.
(8)
Provide information to the public on community development problems
and develop a program of citizen participation.
(9)
Integrate all individual projects or programs, and develop plans
to insure harmonious and integrated planning for the area concerned.
(10)
Prepare and make grant applications to the various funding agencies
for and on behalf of the Department and for any other City department
or agency which requests the Commissioner to do so.
(11)
Perform such other duties as the Mayor or the Common Council
may require.

The Planning Board of the City of Utica as established by ordinance
is part of the Department of Urban and Economic Development. The Planning
Board is organized and performs all the functions and possess all
the powers and duties as provided by ordinance and as otherwise provided
by law.

The Zoning Board of Appeals as constituted by ordinance is part
of the Department of Urban and Economic Development. The Zoning Board
of Appeals shall continue to be organized and perform all the functions
and possess all the powers and duties it presently exercises.

The Mayor may appoint an attorney who shall serve within the
Department of Urban and Economic Development, at the pleasure of the
Mayor, and provide whatever legal services that the Commissioner of
Urban and Economic Development may deem necessary.

The Scenic and Historic Preservation Commission of the City
of Utica as established by ordinance is part of the Department of
Urban and Economic Development. The Scenic and Historic Preservation
Commission shall be organized and perform all of the functions and
possess all the powers and duties as provided by ordinance and as
otherwise provided by law.
