This division applies to curb cuts.

When it is desired to construct a driveway across a curb and
sidewalk, the curb shall not be damaged but shall be removed, lowered
and reset, except that concrete, bluestone and red sandstone curbs
may be cut so that at least three-fourths of an inch projects above
the gutter line, and the section of driveway shall be built so that
there shall be no abrupt changes in either longitudinal or transverse
grades.

For the purpose of constructing a driveway approach, no curb
cut, opening or section broken out or removed shall exceed 20 feet
for residential purposes and 40 feet for commercial or other purposes.

The minimum distance between curb cuts shall be not less than
10 feet measured at the inside of the sidewalk.

No portion of a driveway approach, including the curb return,
shall be constructed within three feet of the point of curvature of
the radius curb at the corner.

The radius of curvature of the curb return shall not exceed
the distance between the curb and the edge of the pedestrian walkway
nearest the curb or, where no walk exists, shall not exceed four feet.

No driveway approach shall interfere with City facilities such
as street lighting poles, traffic signal standards, catch basins,
hydrants, crosswalks, bus loading platforms, utility poles, fire alarm
supports, underground pipes or ducts or other necessary street structures,
and either the Commissioner of Public Works or City Engineer may order
and effect the removal or reconstruction of any driveway approach
which conflicts with street structures or which exceeds the maximum
width of curb cut. The cost of removing, reconstructing or relocating
these driveway approaches shall be at the expense of the abutting
property owner.

No curb cut shall be permitted within an intersection.

It shall be unlawful for any person to construct, alter or extend or permit or cause to be constructed, altered or extended any driveway approach which can be used only as a parking space or area between the curb and private property except for a parking area between the sidewalk and curb authorized pursuant to section
2-16-215.

All pumps, wash racks and islands shall be placed so that vehicles
will not be stopped upon the sidewalk, and in no case shall the setback
from the right-of-way be less than 12 feet.

It shall be unlawful for the owner, occupant or agent of any
property in connection with a driveway on the property to use a wooden,
metal, blacktop or other approach extending from the street to the
top of the curb, and it shall also be unlawful for any person to place
dirt, ashes or other material in the gutter next to the curb for the
purpose of building up an approach for a driveway.
