(a) 
No plumbing installation shall be performed within or on any building, structured or premises, publicly or privately owned, nor shall any alteration or addition be made to any such existing equipment without a permit having first been secured from the Secretary of the Plumbing Board.
(b) 
A separate permit shall be required for each separate building or installation in which plumbing work is to be done.
(c) 
A permit is required for the installation of any new or replacement piping system for the purpose of installing specific Appliances, as defined in Chapter 6 of the Fuel Gas Code of New York State, or any piece of equipment that uses fuel gas.
(d) 
Application for a plumbing permit shall be made to the Secretary, on forms provided for that purpose, by the holder of the master's license who is to supervise the work and installation for which the permit is sought.
(e) 
Each application for a plumbing permit shall be accompanies by two copies of plans and specifications which shall generally include the following information:
(1) 
The nature and character of the work to be performed and the materials to be incorporated.
(2) 
A plot plan, drawn to scale, showing the location and size of all proposed and existing construction and all plumbing systems to be installed, the distance of the construction and systems from lot lines and with widths and grades of adjoining streets, walks and alleys.
(3) 
All plumbing plans and specifications must be sufficiently detailed to indicate the complete plumbing system for each project. Such items as size, kind and weight of pipes and kind of traps, closets and fixtures to be used must be clearly stated.
(4) 
Plans and specifications shall bear the signature of the person responsible for the design and drawings. Where required by Article 145 (§ 7200 et seq.) or 147 (§ 7300 et seq.) of the Education Law, the plans and specifications shall bear the seal and signature of a licensed architect or a licensed professional engineer.
(5) 
The application for a permit shall include the correct address, the type of occupancy or occupancies, and the name of the owner of the premises.
(f) 
The Commissioner may waive the requirements for filing plans and specifications for minor alterations and issue a plumbing permit so stating.
(g) 
Amendments, if any, to the application or the plans and specifications accompanying the application shall be filed with the Secretary prior to the commencement of the change of work,
(h) 
The Commissioner may make inspections of all new and additional plumbing installations and reinspection of all existing plumbing installations.
(i) 
The Commissioner shall make all inspections which are necessary or proper for the carrying out of the Commissioner's duties.
(j) 
No permit required by his division shall be issued to any person other than a holder of a license of the grade necessary to entitle the holder to lawfully do or supervise the work to be done by virtue of the permit.
(k) 
The issuance of a permit shall not be construed as approval of plans, specifications or schedules or of work contemplated by the permit.
(l) 
If no work has been done at the end of three calendar months from the date of the issuance of a permit required by this division, the permit shall be null and void from and after the expiration of the three-month period.

(a) 
The following fees shall be paid at the time of filing an application for a plumbing permit. The fees shall be based upon the valuation of the work to be performed:

(b) 
The City, the Utica Board of Education, the county, the state and the United States of America shall be exempt from paying any fee for any plumbing permit.

(a) 
The Commissioner shall examine or cause to be examined all applications for permits and the plans, specifications and documents filed with the application to ensure compliance. The Commissioner shall approve or disapprove the application within 60 days from the date of submission of the application.
(b) 
Upon approval of the application and receipt of the fees the Secretary shall issue a plumbing permit to the applicant. All permits shall be signed by the Commissioner.
(c) 
Upon approval of the application, both sets of plans and specifications shall be endorsed with the word "approved." One set of approved plans and specifications shall be retained in the files of the Commissioner, and the other set shall be returned to the applicant together with the plumbing permit. The approved plans and specifications shall be kept by the applicant at the building site and available for inspection by the Commissioner at all reasonable times.
(d) 
If the application, plans, specifications or other documents describe proposed work which does not conform to the requirements of this article, the Commissioner shall disapprove the application and shall return the plans and specifications to the applicant. Upon the request of the applicant, the Commissioner shall transmit the refusal, together with the reasons for refusal, to the applicant in writing.

The Commissioner may revoke a plumbing permit when the Commissioner finds:
(1) 
That there has been any false statement or misrepresentation as to a material fact in the application, plans or specifications on which the permit was based.
(2) 
That the permit was issued in error and should not have been issued in accordance with the applicable law.
(3) 
That the work allowed under the permit is not being performed in accordance with the provisions of the application, plans or specifications.
(4) 
The person to whom a permit has been issued fails or refuses to comply with a stop order issued by the Commissioner.

(a) 
The inspector shall make all inspections that are necessary or proper for the inspector to perform assigned duties. The inspector or the inspector's authorized representative may make inspections of all new and additional plumbing installations and reinspections of all existing plumbing installations.
(b) 
The Commissioner shall be notified by the plumber when inspection is desired. The Commissioner shall make the inspection within 24 hours, exclusive of Sundays and holidays, after the time specified. Final inspection shall be made as soon as practical. Telephone requests for inspection will be accepted by the Commissioner or the Secretary.
(c) 
When any part of a plumbing installation is to be concealed from view by replacement of permanent parts of the building, the plumber installing the plumbing shall notify the Commissioner of the conditions. If any portion of the installation has been covered before being inspected, that portion shall be immediately uncovered upon the direction of the Commissioner. If the Commissioner has not completed the inspection within three days after notification, the plumber may cover the work and consider the work to be approved, provided the plumber filed with the Commissioner, a written statement that inspection was not made within the time mentioned in this subsection.
(d) 
All soil, waste and ventilation pipes, building drains and laterals, lead bends, concealed traps and all similar rough work shall be tested with a water or air test in the presence of the Commissioner. Potable water systems shall be tested at 200 per square inch with air or water tests. The water test shall be applied by closing all openings of the system and completely filling the system with water up to a ten-foot head. The air test shall be allowed only when water is not available or when there is danger of freezing. All leaks shall be made tight. Defective work or material shall be replaced and the test applied again.
(e) 
Upon completion of the entire plumbing installation, the plumber shall apply for final inspection.
(f) 
No alteration or addition shall be made to the installation after inspection has been completed without first obtaining the approval of the Commissioner.
(g) 
Schedule of fees for plumbing inspections:
(1) 
Residential construction—New construction, alterations and additions.
Minimum charge: $35, to include the following:
One bathroom of three fixtures;
One hot water tank;
One kitchen sink;
One washing machine;
One dishwasher.
The above will include two visits during a maximum period of 120 days. Each fixture over the minimum will be an additional cost of $3.
(2) 
Commercial construction—New construction, alterations and additions.
Formula: Base price plus cost, plus extra visits.

If the completed plumbing installation is found to be in full compliance with this article, other applicable ordinances, rules and regulations and the laws of the state, the Commissioner shall issue a certificate of approval.

This article shall not be constructed to affect the responsibility or liability of any person owning, operating, controlling or installing any plumbing installation, for damages to persons or property caused by any defect in the equipment or in the installation of the equipment nor shall any duly designated plumbing inspector of the City, any member of the Plumbing Board of the City or the City assume any liability for inspections, reinspections, the issuances of permits or the issuances of licenses.
