[Adopted 6-8-1970 as Sec. 6-9 of the Revised General Ordinances]
As used in this article, the following terms shall have the meanings indicated:
POOL OR BILLIARD ROOM OR PARLOR
Any place in which pool or billiard tables are maintained and are available for use by persons, whether or not a fee or charge is made therefor, and regardless of whether operated as a business or as incidental to some other business use.
POOL OR BILLIARD TABLE
Includes any type of table commonly known as a pool or billiard table, other than coin-operated pool or billiard tables, for which licenses have been obtained under any ordinance of the Town licensing and regulating pinball and other similar machines.
No person shall maintain, operate, conduct or pursue the business or occupation of keeping any public room or place where the games commonly known as "pool" or "billiards" are played without first having obtained a license.
In addition to the information required by § 171-2, the application shall set forth the number of pool and billiard tables to be located upon the premises to be licensed.
After an investigation is made as provided in § 171-3, except that it shall be performed by the Police Chief, Fire Chief and Construction Official, the Clerk shall transmit the application together with the reports to the Council. If the Council shall then find that all of the terms of this article have been complied with and that the issuance of the license shall not be detrimental to the health, safety and welfare of the residents of the Town, the license shall be issued by the Clerk upon resolution being duly passed by the Council and after payment of the license fee.
Any premises which shall be declared to be unsafe by the written report of the Construction Official, or a fire hazard by the written report of the Fire Chief or Construction Official, shall be deemed ineligible for a license.
No license shall be issued for the operation of any pool or billiard room or parlor which is located within 350 feet of any school or church, nor within 500 feet of another pool or billiard parlor. All distances shall be measured as the shortest distance between the nearest building entrances, across the street if the entrances are on opposite sides of the street, and along street frontages if both entrances are on the same side of the street or within the same block.
No licensee shall operate or permit any pool or billiard room or parlor to be operated except between the hours of 9:00 a.m. and 1:00 a.m. on Mondays through Thursdays, inclusive; between 9:00 a.m. and 2:00 a.m. on Fridays and Saturdays; and between 1:00 p.m. and 1:00 a.m. following on Sundays.
A. 
No person under the age of 16 years shall be admitted to or permitted to play pool or billiards in any licensed premises, or to frequent, lounge, congregate or gather in such room or place unless accompanied by his parent or guardian.
B. 
No person under the age of 18 years who is enrolled in any public or private secondary school shall be permitted to enter or remain in any licensed premises after 10:00 p.m. unless accompanied by his parent or guardian.
All premises in which the games of pool or billiards are played shall be on the street floor of a building, and shall be so arranged and lighted that a full view of the interior may be had from the public thoroughfare or from adjacent rooms to which the public is admitted at all hours.
This article shall not apply to a religious, charitable, benevolent or nonprofit association or corporation which operates or maintains any pool or billiard tables solely for the recreation and amusement of its members, provided such organization is bona fide in character and is not intended as a means or device for evading the terms and provisions of this article, nor shall this article apply to the keeping of any pool or billiard tables in private residences.
There shall be conspicuously posted and displayed in any premises licensed under this article:
A. 
The license.
B. 
A copy of this article which shall be supplied to the licensee by the Clerk.
C. 
Not less than one sign giving notice that no person under the age of 16 years is permitted upon the licensed premises unless accompanied by his parent or guardian.
By applying for a license under this article, each applicant shall be deemed to have given any member of the Police Department, for the term of such license, the right to make inspections of the premises involved during business hours without the necessity of a search warrant.
No pool or billiard parlor or place where billiards or pool are played for hire shall be operated unless there is in force a public liability insurance policy to cover any injuries as a result of the use of the equipment or the operation of the billiard or pool parlor or place where billiards or pool are played for hire in the amount of $500,000 for any one occurrence and $500,000 for injury to any one person. A certificate of such policy shall be filed with the Clerk with the application for a license.
