Town of Newton, NJ Article I General Provisions

§ 166-1 Title.

This chapter shall be known and may be cited as "The Land Use Procedures Ordinance of the Town of Newton."

§ 166-2 Copies filed with County Planning Board.

Immediately upon adoption of this chapter, the Town Clerk shall file a copy of this chapter with the County Planning Board, as required by law. The Clerk shall also file with the County Planning Board copies of all other ordinances of the Town relating to land use, such as Chapter 320, Zoning, and Chapter 240, Land Subdivision and Site Plan Review.

§ 166-3 Definition of terms.

Whenever a term is used in this chapter which is defined in N.J.S.A. 40:55D, such term is intended to have the meaning set forth in the definition of such term found in the statute, unless a contrary intention is clearly expressed from the context of this chapter.

§ 166-4 Pending applications.

All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of Article V of this chapter.

§ 166-5 Construction.

This chapter shall be considered part of and shall be read in para materia with Chapter 320, Zoning, and Chapter 240, Land Subdivision and Site Plan Review, of the Code of the Town of Newton.

§ 166-6 Effect on contrary Code provisions.

All sections of Chapter 320, Zoning, Chapter 240, Land Subdivision and Site Plan Review, or any other ordinances of the Town which contain provisions contrary to the provisions of this chapter shall be and are hereby, to the extend of such inconsistency, repealed.

§ 166-7 Effective date.

This chapter shall take effect on September 1, 1976.
