The purpose of this article is to provide direction regarding
the yard waste collection and disposal program of the Town of Newton,
so as to protect the health, safety and welfare, and to prescribe
penalties for the failure to comply.
For the purposes of this article, the following terms shall
have the meanings stated herein:
PERSON
Any individual, corporation, company, partnership, firm,
association, or political subdivision of this state subject to municipal
jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, drive or other
way, which is existing state, county or municipal roadway, and includes
the land between the street lines, whether improved or unimproved,
and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking
areas, and other areas within the street lines.
Collection and disposal of yard waste guidelines:
A. The collection of yard waste will be performed during the spring
and fall at dates established by the Town of Newton.
B. All leaves must be placed in biodegradable bags at the curb or along
the roadway.
C. Yard waste is to be placed at the curb or along the street no more
than seven days prior to the scheduled collection dates.
D. Yard waste may not be placed along the street closer than 10 feet
from any storm sewer inlet.
E. Yard waste shall not be placed within the paved limits of any street
or within the limits of any pedestrian sidewalk areas.
The Town Manager, through the Public Works Supervisor, shall
enforce the provisions of this article. It shall be unlawful for any
person to violate any portion of this article adopted by the Newton
Town Council.

Violations of the provisions of this article shall be punishable as provided in Chapter
1, Article
III, General Penalty.
