As used in this chapter, the following terms shall have the meanings indicated:
PORTABLE LIQUID-FUEL-BURNING SPACE HEATER
Includes any heater, stove or appliance designed for heating of space in structures, using or designed for using kerosene, liquid fuel or other flammable liquids, which is not connected to a flue or chimney and which is capable of being moved while in operation.
Except as hereinafter provided, no person shall use, keep for use, store or maintain for use or permit the use of a portable liquid-fuel-burning space heater in any building or structure which is designed or intended for human occupancy and use or which is actually occupied and used as a habitation by human beings.
Nothing herein contained shall prevent the use of portable liquid-fuel-burning space heaters as follows:
A. 
In time of power failure or other emergency, but only for and during the period of such power failure or emergency.
B. 
Kerosene-burning space heaters may be used only in single-family homes and in nonpublic portions of commercial uses which are permitted in the C-1, C-2, C-3 and C-4 Districts of Chapter 320, Zoning, and which are unattached to any other use or building, unless otherwise prohibited by law.
(1) 
No kerosene-burning space heater shall be used unless it carries an approved seal of the Underwriters Laboratories (UL), Factory Mutual Laboratories (FM) or any other nationally recognized testing laboratory.
(2) 
No person shall use in any kerosene-burning space heater any fuel except K-1 grade kerosene.
(3) 
Any person or business within the Town of Newton selling or distributing kerosene for burning in space heaters shall only sell K-1 grade kerosene for this purpose, and any tank or receptacle used for storing such kerosene for sale shall be clearly labeled as K-1 grade kerosene for use in kerosene-burning space heaters.
(4) 
Individuals dispensing kerosene within the Town of Newton shall place K-1 grade kerosene within containers that are designed solely for the purpose of such storage, and said containers must be clearly marked "KEROSENE."
Except when in use during periods of power failure or other emergency, all portable liquid-fuel-burning space heaters shall be stored in a basement or outbuilding, and all kerosene, liquid fuel or flammable liquid shall be removed from the heaters.
