Unless established by state law, rule or regulation, appointments
to volunteer boards and committees will be made by the City Council.
Unless established by state law, rule or regulation, or by local
law, appointments to volunteer boards and/or committees will be limited
to two consecutive terms. Term lengths are limited from one to three
years as set by City Council. If there are no applicants for a board
or committee when a vacancy occurs, then after three months, and upon
verification by the City Manager that there were no applicants, a
volunteer who had served his/her second term may be reappointed and
allowed to serve another two consecutive terms.
Any member of a volunteer board or committee who misses more
than 1/3 of the total meetings for the calendar year or who misses
three consecutive meetings shall be in violation of this chapter and
is automatically terminated from his or her respective board or committee
effective within 30 days of violation. The Chair will notify the City
Manager if someone is in violation of the attendance policy. The member
being terminated may appeal to the appointing authority for a one-time
waiver.
The City Manager shall at any time after the violation send
a written notice by regular mail to any member violating the attendance
policy requirement advising of their termination. The termination
is not dependent on the mailing of the notice.
The City Council or the City Manager required by law shall appoint
people to fill any vacancy which is created by the termination, resignation
or for any other reason, of a member of a board or committee as stated
herein. The person appointed to fill a vacancy shall complete the
initial term and be allowed to serve two additional terms.
Any person appointed to a City volunteer board and/or committee
shall be required to be a legal resident of the City of Batavia at
the time of appointment and during his/her term, and be required to
execute an Affidavit of Residency.
