In the event of the sale of any structure heretofore erected for three families or fewer, the owner thereof shall be required, prior to the closing of title therefor, to install household fire warning devices and carbon monoxide (CO) detectors as per the Uniform Fire Code, Section 5:70-1.19.[1]

The fire warning device hereinabove provided for shall be sensitive to the visible or invisible products of combustion. Devices that are only heat sensitive or that detect only flames or infrared rays are not authorized. Smoke detectors as referred to in this article shall comply with the following standards: Underwriters' Laboratories Standard No. 168 for photoelectric detectors and No. 167 for ionization-type detectors. All devices and equipment for household fire warning systems shall be approved or listed by a nationally recognized testing laboratory, i.e., Underwriters' Laboratories or FM.
A. 
Each dwelling unit shall be provided with a minimum of one approved smoke detector, installed in a manner and location approved under the New Jersey Fire Code. Said smoke detector shall be equipped with an alarm signal device for warning occupants within the dwelling unit, and such alarm shall be clearly audible in all bedrooms when all intervening doors are closed. Unit must be hard wired and have battery backup. In multiple dwellings, in addition to the household fire warning device in each dwelling unit, there shall be smoke detectors located at the top of each stairway and/or exitway so as to warn the occupants of the dwelling unit or apartments served by each such stairway or exitway.
B. 
Each dwelling unit shall be provided with a minimum of one approved CO detector, installed in a manner and location approved under the New Jersey Fire Code. Said carbon dioxide detector shall be equipped with an alarm signal device for warning occupants within the dwelling unit, and such alarm shall be clearly audible in all bedrooms when all intervening doors are closed. Unit must be hard wired and have battery backup.
All occupied mobile homes shall have a minimum of one approved smoke detector and one carbon dioxide detector installed and maintained in operating condition adjacent to each sleeping area as per the Uniform Fire Code, Section 5:70-1.19.[1]

The installation, testing and maintenance of smoke detectors shall comply with the applicable sections of the latest edition of the National Fire Prevention Association's Standard No. 74, Standard for Household Warning Equipment. It shall be the obligation of the owner of such smoke detectors to maintain the same in operable condition at all times.
The enforcement of the provisions of this article is hereby delegated to the Construction Code Officer or his designee.
Any person, firm or corporation violating the provisions of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, Article II, General Penalty.
