Any of the following acts or conduct within our said Township shall constitute a nuisance and shall be punishable as hereafter set forth:
A. 
The operating or setting up, preparing or equipping for operation any field, lot, piece, strip of land or other real estate within our said Township for conducting of automobile racing in contest or competition between two or more contestants or operators of automobiles or other vehicles either simultaneously or by timing.
B. 
The participation by anyone in the operation of any automobile or other vehicle in a race or speed contest or either for pleasure, profit or prize, or with or without expectation of gain, profit or prize.
C. 
The use of any land or premises for the assembling, congregating or gathering of persons to see, witness or attend any automobile race commonly known as a "drag strip race," "hot rod race" or "stock car race" or the leasing of such to anyone for any such purpose.
D. 
The use of any land in our said Township for the purpose of enabling, facilitating or assisting, either for profit or otherwise, the carrying on of any form of automobile racing, whether admissions or entry charges be made or collected from any person or persons who attends or such exhibition, contest or race is free.

Any person firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues of each section of this Part which shall be found to have been violated shall constitute a separate offense.

In §§ 6-101 and 6-102, inclusive, of this Part, are incorporated herein by reference and made a part of this section with reference to motor-driven go-carts or quarter midges except that with reference to the aforementioned sections, no nuisance shall be constituted or punishable as to motor-driven go-carts or quarter midgets unless five or more motor-driven go-carts or quarter midgets are in operation on the given day in question.

This Part and all its provisions may be enforced in the courts of equity by a proper proceeding to enjoin any of the above named violations by action to be instituted by the Board of Supervisors for that purpose.
