A.
It has been determined that the presence of phosphorus in lawn fertilizer
(any substance used to increase soil fertility) near Township water
bodies causes nonpoint source pollution, which is inimical to the
general welfare.
B.
It is the purpose of this article to prevent conduct that allows
such lawn fertilizer containing phosphorus to be applied, thereby
reducing nonpoint source pollution from stormwater runoff to Township
lakes and streams.
A.
No person, firm, franchise, or corporation shall apply liquid or
granular lawn fertilizer that contains phosphorus.
B.
Lawn fertilizer application shall not be made when the ground is
frozen.
C.
No person shall deposit leaves or other vegetative materials on roads
or within any lake or stormwater drainage system.
D.
Lawn fertilizer applications shall not be made within 10 feet of
any lake or waterway.
The public analysis by any manufacturer of fertilizer shall
be accepted by a court of comparable jurisdiction as admissible evidence
of the phosphorus content of any fertilizer used.
This article shall be enforced by the State Police.
Any person who is guilty of application of residential lawn
fertilizer in the manner described hereinabove shall be punished by
a fine of not less than $5, and not more than $500.
