It shall be unlawful for any person, firm or corporation to keep, maintain or operate what is commonly known as a "junkyard" for the purpose of purchasing, selling and/or storing old junk, old rope, old iron, brass, copper, tin, lead or other metals, old auto cars and other abandoned or nonusable vehicles, old bottles and materials of similar nature without obtaining a license therefor in accordance with the provisions of this chapter.

It shall be unlawful for any person, firm or corporation to keep, maintain or operate what is commonly known as a "secondhand lumberyard" for the purpose of purchasing, selling and/or storing used lumber or used building materials or materials of a similar nature without obtaining a license therefor in accordance with the provisions of this chapter.

All persons, firms or corporations now engaged in or hereafter engaging in the business of motor vehicle junk dealer or dealer in used lumber and used building material shall, from and after the effective date of this chapter, make application to the Township Clerk, who is hereby designated as the license officer for the purpose of this chapter. Said application shall be in writing and shall set forth the name of the person or persons, firm or corporation, their respective addresses or principal place of business, and shall describe the premises upon which said business is to be conducted, giving the street frontage and approximate depth of said premises, and said application shall be accompanied by the license fee hereinafter provided. The Township Clerk is hereby directed to present said applications to the Township Committee at its next meeting and is hereby authorized to issue a license to such person or persons, firm or corporation on approval of the same by the Township Committee. Said license shall be effective from the date of issue to the 31st day of December of the year in which said license is issued, and all persons, firms or corporations, upon the expiration of any license granted hereunder, shall make application to the Township Clerk for a license to conduct said business for the ensuing year or part thereof and shall pay for said license the same fee as hereinafter set forth.
Persons, firms or corporations receiving such license shall pay to the Township of Liberty an annual license fee of $100 therefor; provided, however, that no such license shall be issued without the written approval of the Township Committee, and provided, further, that any such license may be revoked at the option of said Township Committee for good cause of complaint after due notice thereof and a hearing thereon.
No license issued hereunder shall entitle such licensee to operate thereunder at, in or on any other lot, building or location than that which is specified in said license.
No licensee hereunder shall receive in the line of his or her or its business any article or thing by way of pledge or pawn, nor shall be, she or it advance any sum of money on the security of any article or thing.
No licensee hereunder shall purchase any goods, articles or other things whatsoever from any person under the age of 15 years.
Every licensee hereunder who shall receive or be in possession of any goods, articles or things which may have been or are lost or stolen shall forthwith, on demand to view the same, present the same to the Township Committee or to the police authorities of the Township of Liberty.
No junk, old rope, old iron, brass, copper, tin, lead or any other metal, rags, old bottles and materials of similar nature shall be kept on any sidewalk of the Township of Liberty or in front of the place of such business conducted by the licensee as a junk shop.

Any such junk shop or secondhand lumberyard which may be conducted on an open lot in the Township of Liberty, Warren County, New Jersey, shall have a fence adjacent to or along any road or highway upon which the junkyard or secondhand lumberyard fronts. Said fence shall be made of new wood and shall be at least six feet in height and shall have posts four inches by four inches spaced eight feet apart. The board on said fence shall be one inch by four inches, with an opening space between each board of two inches, and shall be placed vertically. There shall be two crosspieces of lumber, two inches by four inches, extending from post to post. The lower crosspiece shall be one foot above the ground; the upper piece shall be five feet above ground. Said boards shall be securely nailed to the crosspieces. Said fence shall be properly maintained so that it does not deteriorate.

All gasoline, fuel or other explosive material shall be drained and removed from any motor vehicle within 24 hours after it is received on any premises so used as a junkyard or secondhand lumberyard in the Township of Liberty, and gasoline, fuel or other explosive material shall either be removed from said premises or kept in a leakproof tank buried on said premises to the sufficient depth so that the top of the tank shall not be nearer to the surrounding ground level than 2 1/2 feet, and said tank, together with the filling parts and vents, shall not be placed nearer to any building located on said premises than 20 feet.
A. 
It shall be unlawful for any automobile junk dealer to permit any vehicle received on any premises in the Township of Liberty to be or remain in the open in such a manner that rainwater shall collect and remain in any of the parts thereof for a longer period than 24 hours.
B. 
All parts of any motor vehicle so designed as to collect and hold rainwater if left exposed in the open shall be housed in a watertight building, with a foundation and floor so constructed of concrete, brick or other suitable material as to prevent the harboring therein of rats, mice or vermin.
All flammable material removed from said motor vehicle and not removed from the premises shall be kept or placed in a fireproof building or room and/or as hereinabove provided.
It shall be unlawful to stack, pile or place parts of motor vehicles upon said junk premises in such a manner as to create a fire hazard or to create a place for the harboring or breeding of rats, mice or vermin.
The Township Clerk, upon the issuance of any license under the provisions of this chapter, shall turn over said license fee to the Township Treasurer.
The Health Officer designated by the Board of Health of the Township of Liberty is hereby authorized and directed, during reasonable business hours, to make reasonable periodic and effective inspection of all of said premises and buildings for the purpose of ascertaining that the business is being conducted on the licensed premises in accordance with the provisions hereof.
All licenses under this chapter shall at all times be subjected to such reasonable rules as may be made from time to time by the Township Committee of the Township of Liberty, Warren County, New Jersey, for the proper operation and regulation of the places of business named in such licenses.

No junk dealers or dealers in used lumber or used building material shall store, keep or maintain any old junk, old rope, old iron, brass, copper, tin, lead or similar old material, old auto cars and other abandoned or nonusable vehicles, old bottles, old appliances and material of similar nature, used lumber or used building materials or material of a similar nature within 500 feet of any adjacent or adjoining real property nor within 500 feet of any street or road.
Any person or corporation violating or refusing or neglecting to comply with any provisions of this chapter shall be liable, upon conviction, to a fine of not more than $1,000 or imprisonment for a period not exceeding 90 days, or both.
