The existence on any property within the Borough of any brush, hedges and other plant life described in and prohibited by this article is hereby declared to be and likely to become traffic hazards and dangerous to the public safety, requiring the cutting or trimming hereinafter required.

The Code Enforcement Officer shall report to the Borough Council the existence on any property within the Borough of any brush, hedges and other plant life growing within 10 feet of any road, street, avenue or thoroughfare and within 25 feet of the intersection of any roads, streets, avenues, or other thoroughfares which are or are likely to be or become traffic hazards and dangerous to the public safety. Such reports to the Borough Council may be recognized by it if coming from any other source.

On the filing of any report described by § 608-2 of this article, or in the event the Borough Council of its own motion, without any such report but after complaint is made, is of the opinion that any brush, hedges and other plant life described and located as set forth in § 608-2 of this article is, or is likely to become a traffic hazard and dangerous to the public safety, the Code Enforcement Officer shall notify the owner or tenant of the property to cut or trim the same within 10 days after notice thereof to a height of not more than 2 1/2 feet where it shall be necessary and expedient for the preservation of the public safety.

In the event the owner or tenant neglects or refuses to cut or trim the same within the ten-day notice period or within any other time herein specified, or as specified in the notice, the required trimming or cutting shall be done by the Director of Public Utilities and the cost thereof, having been certified to the Mayor and Council by the Director of Public Utilities and found correct, shall be charged against the lands abutting or bordering such sidewalks, and become a lien upon such lands and be added to and become in form part of the taxes next to be assessed and levied upon the lands, to bear interest at the same rate as taxes and to be collected and enforced by the same officers and in the same manner.
The notice herein required shall be served upon any owner or tenant residing in the Borough in person or by leaving the same with a member of his family over the age of 14 years; upon an owner or tenant not residing in the Borough either by personal service or by mailing the same to him at his last known post office address or by service upon the occupant, manager, operator or agent of the owner in charge of the property. In the event the owner or tenant is unknown or service cannot for any reason be made, the notice shall be published at least once not less than 30 days before the proposed removal and destruction in a newspaper circulating in the Borough.
