A.
A lot shall be used for the following purposes and no other:[1]
(1)
Uses permitted in the R-1 Zoning District existing prior to the effective
date of this ordinance ____________ (add date of adoption) that were
compliant with the I-4 zoning requirements prior to ___________ (add
date of adoption) may continue to exist as an existing nonconforming
use and may be altered in accordance with the R-1 requirements. New
R-1 uses are not permitted, nor are conversions back to an R-1 use
from a permitted I-4 use.
(2)
Retail stores and showrooms when associated with an industrial use
and not to exceed 50% of the total floor area of the establishment.
(3)
Professional office, business office, agency, studio, medical or
dental offices or clinics.
(4)
Club or lodge.
(5)
Bank or financial institution.
(6)
Personal services such as tailor, barber, beauty salon, dressmaking,
shoe repair and the like.
(7)
Confectionery or bakery.
(8)
Repair and fabrication of items to be sold on the premises, provided
that processing activities, if located on the ground floor, shall
be screened from the front portion of the building by a wall or partition.
(9)
Dry cleaning and self-service laundry.
(10)
Funeral home.
(11)
Trade or business school and private instructional facilities
such as for dance or martial arts.
(12)
Newspaper publishing or similar use.
(13)
Central telephone office; electrical substation.
(14)
Wholesale business.
(15)
Automobile repair, provided that all services are performed
within an enclosed area.
(16)
Car wash, boatyard, marina, boat building, repair and storage.
(17)
Indoor recreation amusement or assembly.
(18)
Contractors' facilities such as plumbing, heating, carpentry,
welding, cabinet making, furniture repair, upholstery.
(19)
Warehouse in conjunction with a permitted manufacturing or processing
use.
(20)
Commercial greenhouse.
(21)
Laboratory for research testing and design, provided that the
use is not hazardous or noxious.
(22)
Manufacture of beverages, clothing, textiles, containers for
food products, cosmetics, electrical appliances (not heavy machinery),
dairy products, jewelry, clocks, medical and scientific instruments,
musical instruments, toys, hardware, stationery.
(23)
Packing, crating, bottling within a fully enclosed building.
(24)
Storage within a fully enclosed building.
(25)
Metal stamping and other light metal processing.
(26)
Accessory uses on the same lot with and customarily incidental
to any of the above permitted uses.
B.
Conditional uses.[2]
(2)
Gasoline service station.
(a)
A maximum of six gas pumps may be located at the facility.
(b)
Drive aisles and parking areas must be set back a minimum of
10 feet from the right-of-way. The setback area must be suitably landscaped.
(c)
Automotive retail sales must be limited to fuels, motor oils
and other lubricants related to the operation of motor vehicles; changing
of tires; changing of motor oil; sale of tubes, batteries, belts,
hoses, lights and the like. Service to adjust, replace parts or condition
a vehicle is permitted. Motor overhauls, replacing engines, painting
of vehicles and body repair and replacement are not permitted.
C.
Prohibited uses.[3]
(1)
Abattoir.
(2)
Assembly or fabrication of large equipment or machinery.
(3)
Bulk storage of fireworks or explosives.
(4)
Fat rendering.
(5)
Incineration or reduction of garbage.
(6)
Leather processing.
(7)
Wood or woodpulp processing.
(8)
Manufacture of asphalt, cement, chemicals, cork, fertilizers, illuminating
gas, slue, ink iron or steel, linoleum, oil cloth, paint, plastics,
rubber, soap, petroleum refining.
(9)
Storage of crude oil or any of its volatile products or other highly
flammable liquids in aboveground tanks (except in accordance with
Borough and state regulations; in no case shall a tank larger than
10,000 gallons be placed closer than 100 feet from any property line).
D.
Where premises abut a residential district, no building shall be
erected within 20 feet of said residential district.
E.
The building line shall be determined in accordance with the existing
established building line on each street.
F.
Except where specific provision is otherwise made in the Code of
the Borough of Westville, where premises abut a residential district,
no commercial business shall be operated from 12:00 midnight to 6:00
a.m. In any application before the Land Use Board, the hours of operation
may be further restricted as a condition to any approval.

Lots used for residential purposes must comply with the area
and other regulations prescribed for the R-1 District. The area, yard
and setback regulations for the I-4 District are set forth in the
Table of Zoning Requirements included at the end of this chapter for
easy reference.
