To provide for the protection of the general public by insuring safe and adequate access over all ways within the town for oversized emergency vehicles for the purpose of providing emergency medical, law enforcement and/or fire protection services.
The traveled portion of all public and private ways in existence at the time of the adoption of this bylaw shall be kept cleared from all brush and/or overhanging tree branches to provide minimum unobstructed clearance of ten (10) feet wide and fourteen (14) feet high. Any public or private way laid out subsequent to the adoption of this bylaw shall be kept cleared from all brush and/or overhanging trees to provide minimum unobstructed clearance of fourteen (14) feet wide and fourteen (14) feet high.
In the event that clearance of a private way is not maintained in accordance with the minimum standards of § 90-2 after thirty (30) days' written notice to the abutters of said private way, the Director of Highways, upon written request by the Chief of the Fire or Police Department, shall have the authority to enter upon said way to perform the minimum trimming necessary to bring said way into compliance with the minimum clearance standards of § 90-2. All reasonable costs of any such town trimming shall be the responsibility of the abutters of said way.
