After due consideration of the petition, maps and plans filed with this Board of Supervisors by the Town of Wilton, and the Report and Recommendations of the Saratoga County Sewer District Commission, and upon the public hearing conducted on said petition, this Board hereby finds and determines as follows:
A. 
That all the property and property owners within the proposed extended boundary area in the Town of Wilton will be benefited by the extension of Saratoga County Sewer District No. 1's boundaries to include the entire Town of Wilton;
B. 
That all the property and property owners in the Town of Wilton benefited by the proposed extension are included within the limits of the proposed extended district; and
C. 
That the proposed extension of Saratoga County Sewer District No. 1's boundaries to include the entire Town of Wilton is in the public interest.
Upon the foregoing findings and determinations, this Board hereby grants the petition of the Town of Wilton to extend the boundaries of Saratoga County Sewer District No. 1 to include the entire Town of Wilton, and the boundaries of Saratoga County Sewer District No. 1 are hereby revised to be more particularly bounded and described as follows:
Beginning at a point being the intersection of the Saratoga-Rensselaer County line and the southbounds of the Town of Halfmoon;
Thence westerly and southerly along said town line to the intersection with the Saratoga-Albany County line;
Thence northerly and southwesterly along the Saratoga-Albany County line for approximately 29,000 feet to the Intersection with the westbounds of "Section 41" as shown in the "Tax Maps of the Town of Clifton Park," Saratoga County, New York, filed June 27, 1968;
Thence northerly along said section bounds and continuing northerly and westerly along the center line of Van Vranken Road for approximately 8,500 feet to the southeast corner of the property shown in the "Tax Maps of the Town of Clifton Park," June 27, 1968, as Section-39; Block-1; Parcel-1:
Thence northerly along the westbounds of said parcel for approximately 2,500 feet to the center line of County Road 92;
Thence northeasterly along the center line of said road for approximately 2, 100 feet to the southwest corner of the property shown in the "Tax Maps of the Town of Clifton Park" June 27, 1968, as Section-40; Block-14; Parcel-2;
Thence northerly along the westbounds of said parcel and continuing northerly along the westbounds of the property shown in said tax maps as Section-32; Block-4; Parcel-13 for approximately 7,300 feet to the center line of Englemore Road;
Thence easterly along the center line of said road for approximately 600 feet to a point 300 feet west of Moe Road as measured at right angles from the center line of said road;
Thence northerly along a line parallel to and 300 feet west of Moe Road as measured at right angles from the center line of said road for approximately 2,400 feet to a point being 300 feet south of Groom's Road as measured at right angles from the center line of said road;
Thence westerly along a line parallel to and 300 feet south of Groom's Road as measured at right angles from the center line of said road for approximately 13,500 feet to a point being 300 feet west of Sugar Hill Road (Miller Road) as measured at right angles from the center line of said road;
Thence northerly along a line parallel to and 300 feet west of Sugar Hill Road as measured at right angles from the center line of said road for approximately 9,300 feet to a point being 300 feet south of Waite Road as measured at right angles from the center line of said road;
Thence northwesterly along a line parallel to and 300 feet west of Waite Road as measured at right angles from the center line of said road for approximately 16,000 feet to a point being 300 feet south of State Highway 146A (Ballston Lake Road) as measured at right angles from the center line of said highway;
Thence northwesterly along a line parallel to and 300 feet southwest of State Highway 146A as measured at right angles from the center line of said highway for approximately 6,000 feet to a point on New York State coordinate 1,058, 400N;
Thence due west for approximately 900 feet to the southbounds of the Town of Ballston;
Thence southwesterly along said town line for approximately 8,300 feet to the Saratoga-Schenectady County line;
Thence northerly along said County line for approximately 8,500 feet to a corner thereof;
Thence westerly along said County line for approximately 4,500 feet to the westbounds of the Town of Ballston;
Thence northerly along said town line for approximately 8,200 feet to a point on New York State coordinate 1,068,550N;
Thence easterly for approximately 12,500 feet to a point on New York State coordinate 1,070,050N being 300 feet west of State Highway 50 as measured at right angles from the center line of said highway;
Thence northeasterly along a line parallel to and 300 feet west of State Highway 50 as measured at right angles from the center line of said highway for approximately 1,000 feet to a point being 300 feet west of Middle Line Road as measured at right angles from the center line of said road;
Thence northerly along a line parallel to and 300 feet west of Middle Line Road as measured at right angles from the center line of said road and continuing on a range with said line for approximately 48,300 feet to a point being 300 feet north of State Highway 29 as measured at right angles from the center line of said highway;
Thence easterly along a line parallel to and 300 feet north of State Highway 29 as measured at right angles from the center line of said highway for approximately 12,600 feet to the west Outside Corporation Line of the City of Saratoga Springs;
Thence northerly along said city line for approximately 4,600 feet to the northbounds of the Town of Milton;
Thence easterly along the northbounds of the Town of Milton for approximately 270 feet to the center line of Lester Park Road;
Thence northerly along said center line of Lester Park Road and Grange Road for approximately 4,250 feet to the southern right-of-way line of the Delaware and Hudson Railroad, Adirondack Branch;
Thence easterly along said right-of-way line for approximately 12,700 feet to the Intersection with the southern right-of-way line of Niagara-Mohawk Power Corporation transmission line O197;
Thence easterly along said right-of-way line for approximately 8,000 feet to the Greenfield-Wilton town line;
Thence northerly along said town line for approximately 31,300 feet to the intersection with the southbounds of the Town of Corinth;
Thence northerly along the Wilton-Corinth town line approximately 800 feet to a bend point in said town line;
Thence easterly along the Wilton-Corinth town line and the Wilton-Moreau town line approximately 26,900 feet to the northwest corner of the Town of Northumberland;
Thence southerly along the Wilton-Northumberland town line approximately 36,700 feet to the northbounds of the Town of Saratoga;
Thence westerly along the Wilton-Saratoga town line approximately 8,800 feet to the northeast corner of the Outside Corporation Line of the City of Saratoga Springs;
Thence southerly along said city line for approximately 10,200 feet to the southeast corner of the Outside Corporation Line of the City of Saratoga Springs;
Thence westerly along said city line for approximately 300 feet to the western right-of-way boundary of the American Telephone & Telegraph overhead cable line;
Thence southerly along said right-of-way boundary for approximately 48,350 feet to the intersection with the line between Lot 7 and Lot 8 in the Grand Division of the Patent of Saratoga;
Thence easterly along said lot line approximately 10,600 feet to a point being 300 feet west of Flike Road as measured at right angles from the center line of said road;
Thence northerly along a line parallel to and 300 feet west of Flike Road as measured at right angles from the center line of said road and continuing on range with said line for approximately 7, 150 feet to a point being 300 feet north of County Road 76 as measured at right angles from the center line of said road;
Thence easterly along a line parallel to and 300 feet north of County Road 76 as measured at right angles from the center line of said road for approximately 7,500 feet to the westbounds of the Village of Stillwater;
Thence southerly and easterly along said village line for approximately 4,300 feet to the Saratoga-Rensselaer County line;
Thence southerly along said County line approximately 42,900 feet to the point or place of beginning.
Pursuant to §§ 256 and 257 of the County Law, this article is adopted subject to permissive referendum. The Clerk of the Saratoga County Board of Supervisors shall cause a notice pursuant to County Law § 101 to be published by no later than December 31, 2004, in The Saratogian and The Ballston Journal, the official County newspapers, and in The Daily Gazette, a newspaper having a general circulation within the boundaries of Saratoga County Sewer District No. 1, stating that this resolution is subject to permissive referendum upon petition signed by the requisite number of qualified electors as provided in County Law § 257 and filed with the Clerk of the Saratoga County Board of Supervisors within 45 days of this date.
This article shall take effect either 45 days from its adoption on this date or, in the event a permissive referendum is held on this resolution pursuant to County Law §§ 101 and 257, upon its approval by a majority of the qualified electors voting on a proposition therefor.
The Clerk of the Saratoga County Board of Supervisors shall cause a certified copy of this article to be filed in the Office of the Saratoga County Clerk by no later than December 31, 2004.
