A.
The Saratoga County Board of Supervisors is committed to the effective
management of solid waste. Effective management is an evolutionary
concept and the actual ongoing experience with that concept changes
our official and personal awareness of its complexities.
B.
The County's enforcement of recycling and reuse has been accompanied
by an unanticipated increase in littering and unlawful refuse disposal
on public highways and adjoining public and private lands. This unfortunate
situation impairs the health and safety of our citizens, diminishes
the beauty and viability of our scenic lands and increases our fiscal
burdens.
C.
A Countywide prohibition against littering and unlawful refuse disposal
will complement our commitment to effective management of solid waste
and will supplement the statewide prohibition of such actions codified
in Vehicle and Traffic Law § 1220. Effective management
of solid waste mandates stricter penalties for littering and unlawful
refuse disposal in the County of Saratoga.
No person shall throw, dump, deposit or place, or cause to be
thrown, dumped, deposited or placed upon any highway, or within the
limits of the right-of-way of such highway, or upon private lands
adjacent thereto, any refuse, trash, garbage, rubbish, litter or any
nauseous or offensive matter.
Any person violating any of the provisions of this article shall
be guilty of a violation punishable by a fine not to exceed $1,000
or community service not to exceed 60 hours or by both such fine and
community service.
