There is established a Construction Code Board of Appeals appointed by Borough Council consisting of three members. The term of office shall be for three years, except for those first appointed, shall be staggered so that the term of office of at least one member shall expire each year. Appointments to fill vacancies shall be only for the unexpired portion of the term.

The Construction Code Board of Appeals shall have jurisdiction as permitted by the applicable sections of the Uniform Construction Code, the regulations as promulgated by the Pennsylvania Department of Labor and Industry and the provisions of the International Building Codes.

The composition of the Construction Code Board of Appeals is as follows:
A. 
A member of the Board of Appeals shall be qualified by training and experience to pass on matters pertaining to building construction. Training and experience may consist of licensure as an architect or engineer, experience in the construction industry and training or experience as an inspector or plan reviewer.
B. 
Members of Borough Council and Borough Code Officials may not serve on the Board of Appeals.
C. 
Members of the Board of Appeals shall reside within the Borough, except that the Borough may fill a position on the Board of Appeals with a qualified person who resides outside the Borough when it cannot find a person within the Borough who satisfies the requirements of this Section.

The Rules of Procedure and Operation of the Construction Code Board of Appeals, which is attached hereto as Exhibit A[1], is hereby adopted and approved.
