Pursuant to N.J.S.A. 43:15C-2, the following positions whose occupants have been determined to be employees and not independent contractors are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
A. 
Township Administrator.
B. 
Township Solicitor.
C. 
Municipal Court Judge.
D. 
Municipal Prosecutor.
E. 
Municipal Public Defender.
F. 
Planning Board Attorney.
Employees serving in the following positions are exempt from the Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
A. 
Registered Municipal Clerk.
B. 
Chief Financial Officer.
C. 
Treasurer.
D. 
Principal Public Works Manager.
E. 
Tax/Utility Collector.
F. 
Tax Assessor.
G. 
Court Administrator.
H. 
Qualified Purchasing Agent.
I. 
Zoning/Code Enforcement Officer.
J. 
Licensed Uniform Subcode Officials and Inspectors.
This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
