"Duty Tow Ordinance."

Licenses will be issued as needed at the discretion of the Board
of Supervisors.

1. Licenses
shall only be issued to towing businesses located within the geographic
boundaries of Warminster Township and that use the towing component
as a primary or secondary part of an auto repair (including body repair
and engine repair) that is wholly owned by the towing entity. Warminster
Township will not issue a license under this Part 8 to towing entities
that lease space for their storage lots.
2. Licensees
are independent contractors of the Township. They do not hold a property
interest in the license and have no right to continual existence of
a license. On-call duty tow license holders must be able to respond
to any public street anywhere in Warminster Township each minute of
the day while on duty. Warminster Township may revoke a license at
any time for any reason.

The duty tow assignments will last one full seven-day week,
starting at a time determined by the Warminster Township Police Chief
and ending seven days later to the minute. The Bucks County Emergency
Services Radio Room shall be given the contact phone number for the
week's assigned duty tow company and shall be instructed by the Police
Chief to use that number for the entire week. The Police Chief may,
during times of declared emergency or declared weather emergency,
activate more than one license holder as needed.

The Board of Supervisors shall periodically, at its sole discretion,
promulgate rules and procedures via resolution for license applications
concerning insurance, operator licenses, tow vehicle registrations,
tow facility storage yards (including office hours), vehicle operator
criminal background checks, on-site and on-vehicle signage, rates
to be charged (as subject to the authority of the Commonwealth of
Pennsylvania insurance regulations) and other rules and procedures
the Board of Supervisors believes to be relevant. The Board of Supervisors
may, at its sole discretion, modify, change, amend, delete or add
to these rules and procedures as it sees fit. The Board of Supervisors
may delegate the drafting of the rules and procedures to the Township
Manager and/or any other Township official. The adoption of the rules
and procedures shall be done at a regularly scheduled, properly advertised
public meeting.
