No person within the Town of Elsmere shall conceal about their
person, except within his or her own domicile, any BB gun, air gun,
gas-operated gun, spring gun, or any realistic toy which a reasonable
person would believe is a real gun in a public area.
Any person violating this article shall be guilty of a misdemeanor
and shall be fined not less than $25 or more than $250 for the first
offense, and not less than $50 nor more than $500 for each subsequent
offense. Each violation shall be a separate offense.
Every person convicted of this violation shall forfeit to the
Elsmere Bureau of Police the weapons or instruments so involved in
the violation of this article.
