BICYCLE — A two-wheeled, in tandem vehicle,
either wheel of which is 20 inches or more in diameter, operated by
human power, but excluding any power-driven vehicle which is required
to be licensed under the laws of the Commonwealth of Pennsylvania.

No person who resides within the Town of Bloomsburg shall operate
a bicycle upon any street, alley or public place within the Town of
Bloomsburg unless the same has first been properly registered and
has affixed thereto a license issued by the Town of Bloomsburg Police
Department.

Every owner of any bicycle within the Town of Bloomsburg shall,
within 10 days of acquisition of such bicycle, file with the Town
of Bloomsburg Police Department a description of the bicycle upon
a form to be provided for that purpose. Upon the execution and filing
of the form, the same shall constitute a registration of such bicycle.
All registrations shall be serially numbered and filed by the Town
of Bloomsburg Police Department.

Upon the registration of a bicycle in accordance with this Part,
the Town of Bloomsburg Police Department shall affix a license, serially
numbered so as to correspond with the registration of such bicycle,
in a prominent place thereon.

The registration of each bicycle shall be permanent and need
not be renewed with the exception of the following circumstances:
A.Â
If the bicycle is sold or transferred to a new owner, if shall be
the duty of the new owner to have the bicycle registered in his or
her name and to have a new license issued therefor.
B.Â
If the original license has been mutilated or destroyed so as to
be unreadable, the owner thereof shall obtain a new license and registration
therefor.

The owner of each bicycle, at the time of registration or reregistration,
shall present the Police Department of the Town of Bloomsburg evidence
of ownership of the bicycle, satisfactory to the Police Department.
The Police Department may refuse to license a bicycle which it deems
to be in an unsafe mechanical condition.

The fee for registration or reregistration of each bicycle shall
be set by resolution of the Town Council of the Town of Bloomsburg
from time to time and shall be paid at the time the license therefor
is issued.

All registrations and licenses issued hereunder are not assignable.
Within 10 days after any bicycle has changed ownership or been dismantled,
such information shall be reported to the Police Department of the
Town of Bloomsburg by the former owner, and the new owner shall register
the bicycle and receive a new license therefor.

No person shall operate any bicycle which is not properly registered
or which fails to have a proper license as required herein, or operate
a bicycle in an unsafe manner.

No person shall ride a bicycle upon any sidewalk, park, school yard
or any public place so as to obstruct pedestrian traffic or endanger
another person's safety. No person shall park or let a bicycle
stand upon any sidewalk, park, path or any public place where it is
an obstruction to pedestrians.

No person shall ride a bicycle on the sidewalk of the following streets,
except for members of the Police Department of the Town of Bloomsburg,
including the Chief of Police, while on duty: Main Street, from Railroad
Street to East Street; East Street, from Third Street to Main Street;
and Market Street, from Third Street to First Street.

No operator of any bicycle shall carry more persons at one time
than the number for which the bicycle is designed and equipped with
the exception of seats attached for carrying small children.

Every bicycle operated upon a street, alley or public place
within the Town of Bloomsburg between 1/2 hour after sunset and 1/2
hour before sunrise shall be equipped with a battery-powered or generator-operated
lamp on the front, exhibiting a light to the front of the bicycle
visible for a distance of 500 feet and equipped with a battery-powered
lamp or red reflector on the rear which shall be visible for a distance
of 500 feet to the rear.

Every bicycle shall be equipped with brakes in proper working
order.

No person shall operate a bicycle on any street or public alley
in the Town of Bloomsburg in violation of any traffic ordinance of
the Town of Bloomsburg or law of the Commonwealth of Pennsylvania.

Any person violating any provision of this Part shall, upon
conviction thereof, be fined not more than $50. A bicycle operated
by any person in violation of this Part because of the lack of a registration
may be impounded by the Police Department of the Town of Bloomsburg,
at its discretion, until such bicycle is registered as herein provided.

As used in this Part, the following terms shall have the following
meanings:
That portion of the highway designed or ordinarily used for
vehicular travel, excluding sidewalks.
Any wheeled vehicle that is self-propelled either by human power or by motor including, but not limited to, skateboards, tricycles, unicycles, scooters, roller skates or roller blades, but excluding therefrom bicycles as set forth in Part 1 of this Chapter. Devices such as wagons or baby carriages, which are propelled by means external to the device, shall not be considered a self-propelled recreational device under this Part.
That portion of the highway designated or ordinarily used
for pedestrian travel.

No person shall ride a self-propelled recreational device upon any
sidewalk, park, school yard or any public place or any roadway so
as to obstruct pedestrian traffic or endanger another person's
safety, or ride a self-propelled recreational device on any highway,
street or roadway in such a manner as to impede the normal flow of
vehicular traffic.

No person shall let a self-propelled recreational device stand upon
any sidewalk, park, path, roadway or any public place where it is
an obstruction or hazard to pedestrians.
3.Â
No person shall ride a self-propelled recreational device onto or
from any bench, chair, flower box, retaining wall or other public
accessory or structure which is not intended for pedestrian foot traffic,
or any stairway or any area or space intended only for pedestrian
foot traffic.
4.Â
No ramps, rails or similar devices shall be used on any street, right-of-way,
parking lot or sidewalk, and no person shall use such ramps, rails
or similar devices in such a manner to cause the person to land on
a street, right-of-way, parking lot or sidewalk.
5.Â
No person or pedestrian shall ride or operate a self-propelled recreational
device on a sidewalk on the following streets: Main Street, from Railroad
Street to East Street; East Street, from Third Street to Main Street;
and Market Street, from Third Street to First Street.
6.Â
No person shall operate or ride a self-propelled recreational device
on any roadway where the volume of speed of the vehicular traffic
or the width of the roadway renders the roadway unsafe or unsuitable
for self-propelled recreational devices.
7.Â
Self-propelled recreational device operators on sidewalks and roadways
shall yield the right-of-way to all vehicular and other pedestrian
(nonself-propelled recreational device) traffic upon the sidewalk
or roadway.
8.Â
No more than one person shall operate or ride on a self-propelled
recreational device at one time.

No person shall operate a self-propelled recreational device
on any roadway or public alley in the Town of Bloomsburg in violation
of any traffic ordinance of the Town of Bloomsburg or the laws of
the Commonwealth of Pennsylvania.

Every person convicted of violation of any provision of this
Part shall be punished by a fine of not more than $50 and shall be
ordered to pay restitution should any damage or injury have resulted
from the act giving rise to the violation of this Part.
