The Town Council of the Town of Bloomsburg, when it declares a local disaster emergency pursuant to 35 Pa.C.S.A. § 7501(b), may establish a curfew and set forth the times when the curfew shall be in effect.

The order or proclamation declaring a local disaster emergency containing the times when the curfew will be in effect shall be given prompt and general publicity as required by 35 Pa.C.S.A. § 7501(b).

Reasonable notice of the declaration of a local disaster emergency and implementation of the curfew shall be given by announcement on local radio and television stations serving the Bloomsburg area, as deemed necessary for reasonable notice by the Chief of Police of the Town of Bloomsburg.

1. 
It shall be unlawful for any person to be present in or upon any public place or in any motor vehicle in operation or parked therein in the Town of Bloomsburg during the times when the curfew is in effect, except as follows:
A. 
Emergency service providers, police, fire, rescue, military, Emergency Management Association, and emergency medical services.
B. 
Essential functions, such as medical emergencies and driving to and from work.
2. 
During the declared disaster emergency, the police shall have the authority to stop all vehicles to determine if the person is engaged in an essential function.

For purposes of this Part, "public place" shall mean any public street, highway, road, parking lot, alley, park, playground, vacant lot or any private building or structure to which the public is invited or in which the public is allowed to remain.

A police officer shall, upon view of a violation of this Part, have the right to stop, desist, investigate, and arrest, without warrant, upon probable cause, where there is ongoing conduct that imperils the personal security of any person or endangers public or private property in accordance with the following guidelines:
A. 
The failure to disperse from the area that is the subject of the declaration of local disaster emergency.
B. 
Failure to follow a lawful order of a police officer.

1. 
Any minor who violates any provision of this Part shall, upon conviction thereof in a summary proceeding, be sentenced to pay a fine of not more than $1,000, to be paid for the use of the Town of Bloomsburg, together with costs of prosecution.
2. 
Any non-minor who violates any provision of this Part shall, upon conviction thereof in a summary proceeding, be sentenced to pay a fine of not more than $1,000, to be paid for the use of the Town of Bloomsburg, together with costs of prosecution, or be sentenced to be imprisoned for not more than 10 days, or both.

The Bloomsburg Police Department and assisting law enforcement agencies shall have the authority to enforce this Part.
