The Office of Borough Manager is hereby created.
As soon as practicable after the passage of this chapter, the Borough Council shall elect by a vote of the majority of the members one person to fill said Office of Borough Manager, who shall serve until the first Monday of January of the even-numbered year succeeding his election and until his successor is elected and qualifies, subject, however, to removal by the Council at any time by a vote of the majority of all the members as stipulated by the Borough Code.

The Borough Manager shall be a citizen of the United States, at least 21 years of age and, during his occupancy of said office, shall reside in said Borough of Boyertown unless the consent of the Council is obtained for residence outside the Borough.

Before entering upon his duties, the Borough Manager shall give a bond to the Borough, with surety or sureties to be approved by the Borough Council, in the sum of $60,000, conditioned for the faithful performance of his duties.
A. 
The Borough Manager shall carry on the business of the Borough under the direction of the Borough Council, and his powers and duties shall relate to the general management of all Borough business not expressly imposed or conferred by statute upon other Borough officers; and the Mayor is hereby authorized to delegate to the Borough Manager, subject to recall by written notification at any time, any of his nonlegislative and nonjudicial powers and duties.

B. 
Subject to recall at any time by resolution of the Borough Council, the powers and duties of the Borough Manager shall include the following;
(1) 
The Borough Manager, under the direction of the Mayor shall execute and enforce the laws of the Commonwealth of Pennsylvania and the ordinances and resolutions of the Borough Council.

(2) 
He shall attend all meetings of the Borough Council and recommend such measures as he shall deem expedient.
(3) 
He shall make a report to the Borough Council, including therein a financial report, once each month and at such other times as the Borough Council may direct upon the affairs of the Borough and keep the Borough Council fully informed and advised of the Borough's financial condition.
(4) 
He shall prepare and submit to the Borough Council before the end of each calendar year a tentative budget for the next calendar year.
(5) 
The Borough Manager shall annually present to the Borough Council, not more than 30 days after the close of the calendar year, a correct and detailed statement and report of the preceding year's work of his office, with a detailed statement of all moneys received and expended.
(6) 
The Borough Manager shall, during his continuance in office, be and is hereby made Borough Secretary and Treasurer. He shall also have supervision of the street and highway maintenance and of the Department of Water and Sewers and all projects thereof and shall be the superintendent and manager of the employees of the Borough engaged in said activities and departments.

He shall collect all water and sewer rents and assessments and prepare the data with reference thereto.
