As used in this article, the following terms shall have the meanings indicated:
PROPERTY
Each parcel of land within the Borough of Boyertown, whether or not the same has any building or buildings of any type or kind erected thereon.
SIDEWALK
Any public passageway between the building line and curb of any property, as hereinbefore defined, within the Borough of Boyertown, whether said passageway is paved or unpaved.
The owner, occupant or tenant of every property fronting upon or alongside any of the streets or alleys in the Borough of Boyertown is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside such property sufficient snow, ice, hail and sleet thereon fallen or formed to provide a path clear of and free from such snow, ice, hail or sleet for a width of three feet within 24 hours after the same shall have ceased to fall or to form.
The owner of a property shall be responsible for conforming to the requirements of the aforesaid section where such property is occupied by such owner or is unoccupied; the tenant or occupier thereof, where such property is occupied by such tenant or occupier only; and the owner thereof where the property is a multiple-business or multiple-dwelling property occupied by more than one tenant or occupier.
In any case where the owner, occupant or tenant, as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of § 168-7 of this article within the time limit prescribed therein, the Borough of Boyertown may proceed immediately to clear sufficient snow, ice, hail or sleet from the sidewalk of such properties as is necessary to provide a path not less than three feet in width as provided by § 168-7 of this article and to collect the expenses thereof, with any additional amount allowed by law, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 168-11 of this article.
It shall be unlawful for any owner, occupant or tenant to throw, cast or deposit or cause to be thrown, cast or deposited any snow, ice, hail or sleet into any street situate within the Borough of Boyertown.

Any owner, occupant or tenant who shall fail to remove any snow, ice, hail or sleet from any sidewalk as required by § 168-7 hereof or who shall throw, cast or deposit or cause to be thrown, cast or deposited any snow, ice, hail or sleet into any street situate within the Borough of Boyertown as forbidden by § 168-10 hereof shall, upon conviction before the Mayor or any Justice of the Peace of the Borough of Boyertown, be sentenced to pay a fine not exceeding $600 for each offense, with costs, and in default of the payment of such fine and costs, said owner, occupant or tenant shall be imprisoned for a period not exceeding 10 days for each offense. Each day's continuance of a violation shall constitute a separate offense.
