A certain document, three copies of which are on file in the office of the Fire Marshal of the Borough of Conshohocken, being marked and designated as the "International Fire Code, 2006 edition," including Appendix Chapters A, C, D, E, F and G (see International Fire Code Section 101.2.1, 2006 edition), as published by the International Code Council, be and is hereby adopted as the Fire Code of the Borough of Conshohocken, Montgomery County, Commonwealth of Pennsylvania, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Fire Marshal of the Borough of Conshohocken are hereby referred to, adopted, and made a part hereof as if fully set out in this Part 5B, with the additions, insertions, deletions and changes, if any, prescribed in § 5-512 of this Part 5B.

The following sections are hereby revised:
1. 
In Section 101.1, insert the words "Borough of Conshohocken" in place of [NAME OF JURISDICTION].
2. 
In Section 109.3, insert the words "summary offense" in place of [SPECIFY OFFENSE]; insert "$1,000" in place of [DOLLAR AMOUNT]; and insert "90 days" in place of [NUMBER OF DAYS].
3. 
In Section 111.4, replace "shall be liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars" with the following: "shall be liable to a fine of not more than $1,000."
4. 
The International Fire Code of 2006 is amended to replace the term “Fire Chief” with the term “Fire Code Official” at each instance which it appears in the Fire Code.

The geographic limit referred to in certain sections of the 2006 International Fire Code is hereby established as follows:
1. 
Section 3204.3.1.1 (geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited): Borough of Conshohocken.
2. 
Section 3404.2.9.5.1 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited: Borough of Conshohocken.
3. 
Section 3406.2.4.4 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks is prohibited): Borough of Conshohocken.
4. 
Section 3804.2 (geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas): Borough of Conshohocken.

Nothing in this Part 5B or in the Fire Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 4 of the ordinance adopting this Part 5B; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Part 5B.
