[Adopted 10-19-1981 by Ord. No. 8-81; amended in its entirety 8-10-1992 by Ord. No. 4-92 (Ch. 91 of the 1990 Code)]
For the purpose of this article, certain words and terms shall be held to have meanings as follows:
GARBAGE
Waste or decayed animal or vegetable matter ordinarily incidental to the conduct of a household, or the handling, storage, sale and service of foodstuffs.
OCCUPANT
Includes the owner, agent, tenant, lessee, caretaker or other person (or corporation) actually occupying or in charge of any premises to which collection service is afforded, provided that, for the purpose of this article, no commercial enterprise shall be deemed to be an occupant.
RUBBISH
Those discarded items and materials that normally result from the use of property within the Township for residential purposes; provided, however, that the following items are specifically excluded:
A. 
Automobile or other vehicle tires.
B. 
Materials that may be harmful to the public health or welfare.
C. 
Any item which shall exceed 200 pounds in total weight.
D. 
Any item which shall exceed six feet in length.
E. 
Brush which shall not be securely tied.
F. 
Earth, boulders, stones and bricks.
G. 
Large amounts of building materials.
H. 
Garbage.
The Township Committee may designate one day in the spring and one day in the fall of each year as "cleanup day." Rubbish only shall be picked up by the Township. In all areas of the Township of Harding, such items eligible for such pickup shall not be placed at the roadside in front of the premises by the occupant or occupants thereof prior to 6:00 p.m., 10 days before the designated pickup day, and not later than 7:00 a.m. of the designated pickup day.
The Township Committee may, from time to time, promulgate rules and regulations to implement this article.
Any occupant or occupants violating any of the provisions of this article or failing or refusing to conform to the provisions hereof shall, upon conviction thereof, be liable to a penalty as provided in § 1-3, General penalty, of the Code of the Township of Harding.
