It shall hereafter be unlawful for any person or persons to
permit any dog, cat or other pet, owned by or under the custody, supervision
or control of such person or persons, to run at large either upon
the public streets, alleys or sidewalks in the Township of Lower Heidelberg
or upon the property of another, including the property of Lower Heidelberg
Township or of any school district.

(a) It shall hereafter be unlawful for any person or persons to permit
any dog, cat or other pet, owned by or under the custody, supervision
or control of such person or persons, to deposit fecal matter upon
the public streets, alleys or sidewalks in Lower Heidelberg Township,
or upon the property of another, including the property of the Township
of Lower Heidelberg or of any school district, without immediately
removing the same and disposing of the same in a sanitary manner.
(b) It shall hereafter be unlawful for any person or persons to permit
fecal matter of any dog, cat or other pet, owned or under the custody,
supervision or control of such person or persons, to accumulate or
remain on property owned or occupied by such person or persons for
a period in excess of 24 hours, without removing the same and disposing
of the same in a sanitary manner.

Any person violating any of the provisions of this Ordinance,
upon conviction thereof before a district justice, shall be fined
a sum not to exceed $600 for each offense, together with the costs
of prosecution, and in default of payment thereof, shall be committed
to the Berks County Prison for a period of not more than 30 days.
Each day or portion thereof during which violation shall continue
shall be deemed a separate offense and punishable as such.

If any section, subsection, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by a
court of competent jurisdiction, such section, subsection, clause,
phrase or portion shall be deemed a separate and independent provision
and such holding shall not affect the validity of the remaining portions
thereof.

No person shall be permitted to harbor a vicious or dangerous
animal unless said animal is humanely caged or the public is otherwise
safeguarded from any danger which said animal may present to the life,
liberty or property of any person or persons; and no person shall
cause or allow any livestock, domesticated or undomesticated animals,
including feline animals, to run at large over public or private properties
which are now owned by or which are not in the legal possession or
control of the owner of said animals. For the purpose of this Ordinance,
an animal shall be presumed to be running at large if it is not within
the immediate control of its owner, said control being in the form
of a tether, leash or other appropriate controlling device.

Any person or persons violating any of the provisions of this
Ordinance, or neglecting to comply with any order or notice issued
pursuant to a violation of any section hereof, shall, upon conviction
before any Alderman or Justice of the Peace, be sentenced to pay a
fine not exceeding $600 for each offense with costs to be recovered
in the name of the Township of Lower Heidelberg, Berks County, Pennsylvania,
and if the amount of said judgment and costs shall not be paid, said
person or persons shall suffer imprisonment in the Berks County Prison
not exceeding 30 days.

The word person used in this Ordinance shall in all cases include
any individual or individuals, partnership, association or corporation,
singular or plural, including the responsible officers of any such
association or corporation.

The provisions of this Ordinance shall be severable, and if
any of its provisions shall be held to be unconstitutional, invalid
or beyond the power of the Township of Lower Heidelberg to prohibit
the decision so holding, said provision or provisions shall not be
construed to affect the validity of any of the remaining portions
of this Ordinance. It is hereby declared as the intent of the Supervisors
of the Township of Lower Heidelberg that this Ordinance would have
been adopted had such unconstitutional, invalid or unauthorized provision
or provisions not been included therein.
