No application for approval of a land development activity (land
disturbance of equal to or greater than one acre) shall be approved
until the Planning Board has received a stormwater pollution prevention
plan (SWPPP) prepared in accordance with the specifications in this
chapter.
The SWPPP shall be prepared by a licensed professional or the property owner and must be signed by the property owner who shall certify that the design of all stormwater management practices meet the requirements and technical standards in this chapter. If the plan does not meet the technical standards listed in Article

The licensed professional can be either a licensed engineer in New York, a registered landscape architect or a certified professional in erosion and sediment control (CPESC). The licensed professional and property owner must sign the following certification:
"I certify under penalty of law that this document and all attachments

a system designed to assure that qualified personnel properly gathered
and evaluated the information submitted. Based on my inquiry of those
persons directly responsible for gathering the information, the information
submitted is, to the best of my knowledge and belief, true, accurate
and complete. I am aware that false statements made herein are punishable
