The Board of Trustees of the Village of Saugerties finds that
the accumulation of inoperable motor vehicles on premises within the
Village is unsightly, is a threat to property values, is a potential
safety hazard to children, is a source of annoyance to neighboring
property owners, and is a general public nuisance and threat to the
environment. Accordingly, the Village Board declares that the storage
of such inoperable vehicles constitutes a threat to public health
and safety.
As used in this chapter, the following terms shall have the
meanings indicated:
Keeping or storage of such a vehicle upon premises anywhere
within the Village of Saugerties is prohibited, with the following
exceptions:
On the premises of a New York State registered motor vehicle
repair shop or a public gasoline/service station, provided that such
occupancy is permitted under the Village Zoning Law[1] and any such other
state laws and regulations as may apply thereto.
On the premises of a licensed automobile dealer if the location
of such dealer is permitted by the Village Zoning Law.
Within a permanent, fully enclosed building, including a garage.
Vehicle belongs to a family member serving in active duty in
the armed forces.
Seasonal vehicles during their off-season if kept in a location
not visible from any street, highway or sidewalk.
A recreational vehicle may be stored on the rear yard of a lot,
provided that it is stored and maintained in a neat and orderly manner.
A maximum of one unlicensed vehicle may be displayed for private
sale within a six-month period on any property in the Village of Saugerties.
If after the six-month period the car was not sold, the vehicle must
be removed from the property or it must be properly registered with
the New York State Department of Motor Vehicles.

A motor vehicle which is not currently legally registered
or which does not exhibit a currently valid safety inspection sticker
and is therefore not legally operable on public streets. The fact
that such a vehicle is capable of locomotion shall not affect its
inclusion within this definition.
All vehicles propelled by a means other than muscular power
and intended for use on public highways or waterways and as defined
in § 125 of the New York State Vehicle and Traffic Law.
Any location within the Village of Saugerties, including
public streets, parks and public parking lots.
It shall be unlawful for any person, firm, corporation or other
entity, whether as owner, lessee or occupant, to cause or permit the
unauthorized accumulation of inoperable motor vehicles anywhere within
the limits of the Village of Saugerties.
If the person or entity responsible for causing or permitting
the accumulation of inoperable motor vehicle(s) cannot be determined
upon reasonable inquiry, the owner of the premises whereupon such
vehicle is discovered shall be notified to remove same within 10 days,
via certified mail, return receipt requested, by the Building Inspector.
A.
Violators hereof shall be guilty of a violation in accordance with
Penal Law § 10.00, Subdivision 3, punishable by a fine not
exceeding $250 in accordance with Penal Law § 80.05, Subdivision
4, and a term of imprisonment not to exceed 15 days, or by both.
B.
Each week that such violation persists shall constitute a separate
offense hereunder.
C.
In addition to the above provided penalties, the Village Board may
maintain an action or proceeding in the name of the Village in a court
of competent jurisdiction to compel compliance with, or to restrain
by injunction the violation of, this chapter.
Violators hereof shall be issued an appearance ticket by the
Building Inspector or police returnable in the Village Court and shall
be prosecuted therein.
Inoperable motor vehicles found within the Village streets,
rights-of-way or on other Village property, whose owners cannot be
found with due diligence, may be treated as abandoned property under
the provisions of the Personal Property Law and General Municipal
Law.
