A. 
All sidewalks shall only be concrete and have a minimum width of four feet, meeting the construction requirements of § 167-39. The width of the sidewalk may be increased to greater than four feet in order to match existing sidewalk widths within that particular block; or to establish a specific desired pattern by the Borough. The determination of sidewalk width shall be only made by the Municipal Construction Official or his or her official designee.
B. 
The location and width of any new or replaced sidewalk shall be such to create an open space between the existing curbline and edge of sidewalk to be known as a governor's strip. The width of sidewalk and the "governor's strip" shall vary from street to street and shall be constructed in accordance with a list on file in the Municipal Construction Code Official's office.

Prior to any work taking place within the street right-of-way, the contractor/property owner shall receive a road opening permit from the Public Works Department. Failure to receive proper permitting prior to installation of new, or replacement of existing, sidewalk and sidewalk apron will result in immediate removal of the work performed.
The property owner shall be responsible for the maintenance of all concrete, stone, and/or vegetation within the governor's strip. The Borough will not be responsible for any damage to irrigation systems within the governor's strip that are damaged due to municipal construction.
A. 
Failure to maintain vegetation within the governor's strip shall constitute a violation of this article. When the Construction Code Official, or his or her designee, determines that the property owner is in violation of all, or part, of this article, a certified letter shall be sent to the property owner directing that said violation be abated within 10 days from the date of said notice. Failure to abate said violation will result in the Borough performing all work to abate said violation and the property owner subject to a lien on his/her property for the Borough's cost of such work.
B. 
Continual persistence in failure to meet the requirements of this article shall result in legal action by the Construction Code Office and subject the property owner, upon conviction, to a fine of not more than $500, or imprisonment in the county jail for not more than 90 days, or both.
