Violations and penalties. Any person violating the terms of this section shall be subject to a maximum penalty of $15.

A. 
From November 1 to April 1 of each year, no person shall park any motor vehicle on any public highway between the hours of 12:00 midnight and 8:00 a.m. or at any other time in such a manner as to impede snow removal operations.
B. 
Any vehicle parked in violation of Subsection A hereof may be towed by the Road Agent, the Chief of Police or their agents, or by independent contractors engaged by the Road Agent or Police Chief. Any vehicles so towed shall be stored and released to the owner only upon payment of the cost of towing as established from time to time by the Board of Selectmen.
C. 
Any person violating Subsection A hereof shall be subject to a penalty not to exceed $25 for each offense.

A. 
Definitions. For the purposes of this section, the following terms, phrases, words and their derivations shall have the meaning given herein. When not consistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
NO THROUGH TRUCK ROUTES
A way over certain streets in the Town, as designated herein, over and along which trucks cannot operate.
PERSON
Any person, firm, partnership, association, corporation, company, or organization of any kind.
TOWN
The Town of Bedford.
TRUCK
Any motor vehicle designed, used or maintained primarily for the transportation of the property of greater than 26,000 pounds manufacturer's gross vehicle weight rating or gross combination weight rating of more than 26,000 pounds; or

(1) 
Any motor vehicle equipped with other than pneumatic tires; or
(2) 
Any motor vehicle that satisfies the definition of "Tractor-Trailer" as defined by RSA 259:109; or
(3) 
Any vehicle of any size used in the transportation of material found to be hazardous pursuant to RSA 147-B:2VII and/or 147-B:2VIII; or
(4) 
Any vehicle designed to transport more than 15 passengers including the driver.
B. 
Application of regulation. All trucks within the Town shall be operated only over and along the routes which truck travel is permitted.
C. 
Exceptions: This section shall not prohibit:

(1) 
Any school bus as defined by RSA 259:96;
(2) 
Any mixed-use school bus as defined by RSA 259-96-a;
(3) 
Any antique vehicle as defined by RSA 259-4 equipped with other than pneumatic tires;
(4) 
Any vehicle owned and/or operated by or at the direction of the Town of Bedford;
(5) 
Operation on street of destination. The operation of trucks upon any street where necessary to the conduct of business at a destination point, provided that streets upon which such traffic is permitted are used until reaching the intersection nearest the destination point;
(6) 
Emergency vehicles. The operation of emergency vehicles upon any street in the Town;
(7) 
Public utilities. The operation of trucks owned or operated by the Town, public utilities, or any contractor or material man, while engaged in the repair, maintenance or construction of streets, street improvements, or street utilities within the Town;
(8) 
Detour trucks. The operation of trucks upon any officially established detour in any case where such truck could lawfully be operated upon the street for which such detour is established.
D. 
There is hereby established within the Town the following routes where no through trucking shall be allowed, unless an exception is allowed as aforementioned:

E. 
Enforcement.
(1) 
Maintenance of maps. The Town Clerk shall keep and maintain accurate maps setting out no through truck routes on which truck traffic is not permitted, the maps shall be kept on file in the office of the Town Clerk and shall be available to the public.
(2) 
Posting of signs. The Department of Public Works is authorized to post "no through trucking" signs as listed above.
(3) 
Failure to post. A person shall not be charged with violating the provisions of this section by reason of operating a truck upon a street wherein truck travel is prohibited unless appropriate signs are posted on such street.
F. 
When effective. This section shall become effective two weeks after the date on which the Town Council adopted said ordinance.
G. 
Violations and penalties.

(1) 
The fines for violation of this section are as follows:
(a) 
First: $250 per violation;
(b) 
Second: $500 per violation;
(c) 
Third: 5750 per violation;
(d) 
Fourth and each additional violation: $1,000 per violation for violations occurring within three calendar years from the date of the first violation.
(2) 
If said fine is not paid by the due date, an additional amount of $10 per day will be assessed until paid.
(3) 
The operator of any vehicle in violation of this chapter and section shall be responsible for any and all fines as set forth herein.
(4) 
Violations of this chapter and section by an operator occurring more than three years after the date of the first violation shall be considered a "first" violation and that successive violations shall adhere to the fine schedule set forth in § 262-5G(1), above.[1]

A. 
This section shall govern, regulate and control vehicular parking on the following Town of Bedford properties:
(1) 
Sportsman Field Parking, Nashua Road Student Parking Area, LOT-1 COLOR GREEN.
(2) 
11-13 Nashua Road (former DPW facility) Student Parking Area, LOT-2 COLOR BLUE.
(3) 
Town Pool and Recreation Facilities - County Road Student Parking Area, LOT-3 COLOR YELLOW Parking Area.
(4) 
Town of Bedford Tennis Court Parking - County Road.
B. 
Vehicular parking in the locations specified in Subsection A(1) through (3) above is restricted to only those holding a valid Town of Bedford High School student parking permit and when:
(1) 
Bedford High School is in session beginning 1/2 hour before Bedford High School classes begin and continuing thereafter until 1/2 hour after Bedford High School classes end, including any changes in class schedule due to weather or as specified by the Superintendent, Bedford School District;
(2) 
Bedford High School is open for classes during the school year as specified by the Superintendent, Bedford School District.
C. 
Public parking areas:
(1) 
Vehicular parking at the Bedford Tennis Court, identified as "TENNIS PARKING ONLY — ALL OTHERS TICKETED AND TOWED" is restricted to members of the public that are actively using a tennis court. Any vehicle parked for any length of time in a parking spot identified as "TENNIS PARKING ONLY — ALL OTHERS TICKETED AND TOWED" shall be subject to a Town of Bedford parking violation as per Subsection C(3) and shall be towed from the parking spot at the owner's expense.
(2) 
Vehicular parking at the Bedford Town Pool and Recreation Facility in spaces not designated for use as Town of Bedford High School student parking is restricted to members of the public that are actively using the Town Pool or Recreation Facilities; all others will be ticketed as per Subsection C(3), and the vehicle shall be towed at the owner's expense.
(3) 
Anyone who parks at the Town Tennis Court(s) or the Town Pool or Recreation Lot who is not actively using the Town Tennis Court Facility or the Town Pool/Recreation Facilities at 20 County Road shall be fined not less than $100 for the first offense and $200 for each successive offense, and the vehicle shall be towed at the owner's expense. For the purposes of this section, the registered owner of the vehicle in violation shall be subject to the provisions of this section.
D. 
Parking in the locations specified in Subsection A(1) through (3) is unrestricted except as regulated in Subsection B, but no overnight parking is permitted in the locations specified in Subsection A(1) through (4).
(1) 
Overnight parking is defined as any time 1/2 hour after official sunset as defined by the National Weather Service until 1/2 hour before official sunrise except:
(a) 
When the Bedford High School facilities are open for an authorized and sanctioned school or Town event, including athletic event(s) and non-school-related private events as approved by the Superintendent of Schools or designee;
(b) 
When the recreation facilities contiguous to locations in Subsection A(1) through (4) are in use as authorized and permitted by the Town of Bedford Parks and Recreation Department;
(c) 
Outdoor lighted facilities contiguous to parking locations specified in Subsection A(1) through (4) are in use (Outdoor lighted facilities are considered closed once lights are no longer on.);
(d) 
When the Parks and Recreation Department may allow special activities after hours in concurrence with the Police Chief for which parking in locations in Subsection A(1) through (4) may be permitted as restricted and directed by the Chief of Police.
E. 
Town of Bedford High School student parking permit(s):
(1) 
Requirement: Bedford High School student parking permit(s) are required and must be displayed to park a vehicle in the locations specified in Subsection A(1) through (3) during those date(s) and time(s) as per Subsection B(1) and (2).
(2) 
Qualification(s): In order to submit an application for a Town of Bedford High School student parking permit, the applicant must be a registered Bedford High School student or the parent/guardian thereof and satisfy any/all other requirements established by the Town Manager.
(3) 
Obtaining a Town of Bedford High School student parking permit: Town of Bedford High School student parking permits may be obtained by qualified and approved applicants from the Town of Bedford Finance Department.
(a) 
Qualified applicants or a parent or legal guardian of a qualified applicant must submit all required document(s) and the fee to the Finance Department.
(4) 
Permit parking plan:
(a) 
Each Town of Bedford High School student parking lot and spot number shall be assigned in a process as determined by the Town Manager or designee.
(b) 
Town of Bedford High School student parking permit(s) are valid only for the specified lot and space for the specified school year and are not valid in any other student parking lot or space. Violation of this section will subject the permit holder, operator or owner of the vehicle to a penalty as set forth in Subsection F, and the vehicle in violation shall be towed at the owner's expense.
(c) 
Town of Bedford High School student parking permit(s) are not transferable between students/qualified applicants and are valid only when used by the qualified and approved permit holder. One permit per qualified applicant only.
(d) 
Town of Bedford High School student parking permit(s) may be used by the qualified and approved permit holder in any vehicle that is legally registered in the State of New Hampshire or other state and must be clearly displayed and visible from the front windshield of the vehicle.
(e) 
Lost/stolen parking permits: Lost/stolen/misplaced Town of Bedford High School student parking permits may be replaced upon application by the approved permit holder or the permit holder's parent or legal guardian to the Town of Bedford Finance Department for a replacement permit accompanied by the required fee.
F. 
Enforcement and violation(s):
(1) 
The registered owner of any vehicle who violates any of the terms, conditions, or requirements set forth in this section shall be subject to a penalty of $25 for the first offense, $50 for the second or most recent offense that occurs within one year from the first or most recent offense and $100 for the third offense that occurred within one year and each successive violation that occurs within one year from the first or most recent offense except for violation(s) as per Subsection C above.
(2) 
Vehicles parked in violation of this section shall be subject to the penalties set forth in Subsection F(1) by ticketing by the Bedford Police Department in conformance with the penalties set forth in Subsection F(1), and the vehicle in violation shall be towed at the owner's expense.
(3) 
Any use of any altered, unauthorized manufactured, unauthorized duplication, stolen or counterfeit Town of Bedford High School student parking permit shall be subject to a penalty of $200, and any Town of Bedford High School student parking permit and/or privileges shall be revoked for one calendar year from the time the penalty was assessed.
(4) 
This section and any/all subsections shall be enforced by any duly sworn member of the Bedford Police Department or any municipal police officer assigned to an authorized detail assignment by the Bedford Police Department for any event(s) that require use of any locations specified in Subsection A(1) through (4).
G. 
Effective: This section will be effective upon passage.
