It shall be the duty of the Code Enforcement Officer to enforce the provisions of this chapter and the determinations of the Planning Board and of the Zoning Board of Appeals. Any person who violates this chapter shall be guilty of a violation, and upon conviction thereof, shall be subject to a fine of not less than $100, and not more than $500, or imprisonment for a term not to exceed 15 days, or both. Each day of a continuing violation shall be deemed a separate offense. Prosecution under this section shall be cumulative and in addition to any other remedies provided by law.
In addition to those penalties proscribed by any law, any person who violates any provision of this chapter shall be liable to a civil penalty of not more than $200 for each day or part thereof during which such violation continues. The civil penalties provided by this section shall be recoverable in an action instituted in the name of this Town. This remedy shall be cumulative and in addition to any other remedies provided by law.
An action or proceeding may be instituted in the name of this Town, in a court of competent jurisdiction, to prevent, restrain, enjoin, correct, or abate any violation of, or to enforce, any provision of this chapter, and, in the event of a successful prosecution of the claim, shall be responsible for any and all cost associated with bringing this action to enforce, including, without limitation, attorneys' fees, expert witness fees and court cost, which shall become a charge to be added to the tax roll of the subject property. This remedy shall be cumulative and in addition to any other remedies provided by law.
