It shall be unlawful to sell or distribute alcoholic beverages in the Borough of Edgewater without a license previously applied for and granted pursuant to the provisions of this article and/or the New Jersey Revised Statutes.
The Mayor and Council of the Borough of Edgewater shall constitute the authority for the administration of the issuance of licenses and shall forthwith report the issuance of all such licenses to the Director of Alcoholic Beverages.

The fees for licenses, per annum, shall be as follows:

Not more than 17 plenary retail consumption licenses shall be outstanding in the Borough at the same time. Not more than one plenary retail distribution license shall be outstanding in the Borough at the same time.[1]

Editor's Note: N.J.S.A. 33:1-12.14 provides that no new plenary or seasonal retail consumption license shall be issued until the combined total number of such licenses is fewer than one for each 3,000 of the municipality's population according to the most recent estimates issued by the U.S. Bureau of the Census; provided, however, in the year that the official federal decennial counts are received by the Governor, those federal decennial counts shall be used. No new plenary retail distribution license shall be issued until the combined total number of such licenses is fewer than one for each 7,500 of the municipality's population according to the most recent estimates issued by the U.S. Bureau of the Census; provided, however, in the year that the official federal decennial counts are received by the Governor, those federal decennial counts shall be used. This does not affect existing licenses but will become operative if any licenses are abandoned or revoked.
No limited retail distribution license and no seasonal retail consumption license shall be granted within the Borough of Edgewater.

No more than two retail licenses shall be granted to any person, corporation, partnership, limited partnership or association in the Borough of Edgewater, and each license shall cover only the licensed premises.
No license of any class shall be issued contrary to any zoning regulations now existing or hereafter enacted in this municipality.[1]

A. 
No alcoholic beverages shall be sold, served, delivered to or consumed in any licensed premises on any day between the hours of 3:00 a.m. and 7:00 a.m., except Sundays and New Year's Day each year as hereinafter provided. The provisions of this subsection shall not apply on Sunday. On Sundays, no alcoholic beverages may be sold, served, delivered to or consumed in the licensed premises between the hours of 3:00 a.m. and 1:00 p.m. The provisions of this subsection shall not apply on January 1. On that day no alcoholic beverages may be sold, served, delivered to or consumed in the licensed premises between the hours of 5:00 a.m. and 7:00 a.m., unless January 1 is a Sunday, in which case no alcoholic beverages may be sold, served, delivered to or consumed in the licensed premises between the hours of 5:00 a.m. and 1:00 p.m.
B. 
During the hours the sale of alcoholic beverages is prohibited, the entire licensed premises shall be closed, and no person shall be allowed to remain on the licensed premises except the licensee and employees of the licensee.
C. 
The closing provisions as set forth in Subsection B shall not apply to liquor-licensed bona fide restaurants, hotels and clubs.[1]

Editor's Note: Four sections which formerly followed this section, the first of which prohibited the sale of alcoholic beverages to minors, mental defectives, drunkards or intoxicated persons; the second of which prohibited females from dispensing alcoholic beverages; the third of which regulated the floor space of premises; and the last of which prohibited service of alcoholic beverages in private rooms, except for hotels, were repealed 9-3-1975 by Ord. No. 581-75.
Violations of the provisions of this article shall be punishable as provided in Chapter 1, Article II, General Penalty.
