Pursuant to Section 11 of the Uniform Fire Safety Act (L. 1983, c. 383; N.J.S.A. 52:27D-202), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.), shall be locally enforced in the Borough of Edgewater.

The Edgewater Fire Prevention Bureau shall hereinafter be known as the "local enforcing agency."
A. 
The local enforcing agency shall enforce the Uniform Fire Code in all buildings, structures and premises within the established boundaries of the Borough of Edgewater other than one- and two-family owner-occupied dwellings used exclusively for dwelling purposes and buildings, structures and premises owned by the federal government or interstate agencies of the state.
B. 
The local enforcing agency shall faithfully comply with all the pertinent requirements of the Uniform Safety Act and the Uniform Fire Code.

A. 
The Edgewater Fire Prevention Bureau established by § 204-7 of this article shall be under direct supervision and control of the Fire Official, who shall report to the Mayor and Council.
B. 
The Edgewater Fire Prevention Bureau shall have at least one paid inspector.
A. 
Appointment and qualifications of the Fire Official. The Fire Official shall be certified by the state and appointed by the Mayor and Council pursuant to N.J.S.A. Title 11A, Department of Personnel, of the Revised Statutes.
B. 
Appointment and qualifications of fire inspectors and other employees. Inspectors and other employees of the enforcing agency shall be appointed by the Mayor and Council upon recommendation of the Fire Official. Fire inspectors shall be certified by the state.
C. 
The Mayor and Council shall, specifically, appoint legal counsel to assist the agency in enforcing the Uniform Fire Code.
D. 
Terms of office.
(1) 
The Fire Official shall serve a term of office pursuant to N.J.S.A. Title 11A, Department of Personnel, of the Revised Statutes.
(2) 
Fire inspectors shall serve a term of office pursuant to N.J.S.A. Title 11A, Department of Personnel, of the Revised Statutes.

E. 
Removal from office.
(1) 
The Fire Official shall be subject to removal by the Mayor and Council pursuant to N.J.S.A. Title 11A, Department of Personnel, of the Revised Statutes.
(2) 
Fire inspectors and other employees shall be subject to removal by the Mayor and Council pursuant to N.J.S.A. Title 11A, Department of Personnel, of the Revised Statutes.

The Edgewater Fire Prevention Bureau established by § 204-7 of this article shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

In addition to the registrations required by the Uniform Fire Code, the following non-life-hazard uses shall register with the Edgewater Fire Prevention Bureau. These uses shall pay an annual fee as follows:

A. 
Buildings owned by the Borough of Edgewater are exempt from fees imposed by this article. Buildings of life-hazard use owned by the Borough of Edgewater shall be regulated in accordance with the applicable state regulations.
B. 
Buildings owned by the Borough of Edgewater are subject to all the required inspections and regulations pursuant to the Uniform Fire Safety Act.
C. 
All nonprofit corporations, including churches, fraternal organizations and other corporations which are classified as nonprofit corporations under Title 15A, the New Jersey Nonprofit Corporation Act, shall not be required to pay the Borough of Edgewater any registration or permit fee set forth in this article. This does not exempt the nonprofit organization from registration, inspections and compliance to the Uniform Fire Code. Life-hazard nonprofit organizations are regulated by the State Division of Fire Safety.
If the required non-life-hazard registration fee is not paid to the Edgewater Fire Prevention Bureau by March 31 of the current year, a twenty-five-dollar late fee will be charged. An additional fifty-dollar late fee will be charged for each following month or part thereof that the registration fee is delinquent.
The owner/owners of businesses which require non-life-hazard registration fees to be paid under the article shall be responsible for the payment of said fees.
The Fire Official and/or fire inspectors may affix penalties as are permitted by the Uniform Fire Code.
Pursuant to the Uniform Fire Code, any person aggrieved by any order of the Edgewater Fire Prevention Bureau shall have the right to appeal to the Construction Board of Appeals of the County of Bergen.
The permit fees established by the Uniform Fire Code shall be used.
Fees for a copy of a report shall be established by the Open Public Records Act, Chapter 404 of the Laws of 2001 (N.J.S.A. 47:1A-1 et seq.).
