There are hereby established in the Borough of Edgewater restricted parking spaces pursuant to N.J.S.A. 39:4-197.5 for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles in accordance with the provisions of N.J.S.A. 39:4-205 when using a motor vehicle on which is displayed a certificate for which a special vehicle identification card has been issued pursuant to N.J.S.A. 39:4-206.
A restricted parking space shall be established by one of the following:
A. 
There has been adopted an ordinance, resolution or regulation creating such parking space.
B. 
An approval has been granted by the appropriate land use agency of the Borough of a development application, the plans for which designate the particular space as being restricted for use by handicapped persons in accordance with N.J.S.A. 52:32-12.
C. 
An ordinance has been adopted establishing a restricted parking zone in front of a residence occupied by handicapped persons pursuant to N.J.S.A. 39:4-197.6.

A. 
In connection with the establishment of a restricted parking space as set forth in § 186C-2, the Borough may issue a permit for such space identifying the specific motor vehicle entitled to the utilization of such space, pursuant to the provisions of N.J.S.A. 39:4-197.7. A permit shall be issued only to a person who can prove ownership and operation of the motor vehicle and residency at the location specified thereon and who has no available on-premises parking. The permit shall be prominently displayed on the vehicle and shall be of a size consistent with the statutory requirement. Only a motor vehicle for which a valid permit has been issued and which has such permit properly displayed shall be permitted to be parked in the restricted parking zone indicated on such permit.
B. 
A permit under Subsection A of this section shall be issued for the time period that is concurrent with the time period for which the applicant therefor has been issued a special vehicle identification card, windshield placard or wheelchair symbol license plates by the Division of Motor Vehicles and shall be required to be renewed at the same time for the permit to continue to be valid. In the event that no time period is specified, then such permit shall be required to be renewed on an annual basis.
Any person causing a motor vehicle to be parked in a restricted parking space without possessing the necessary vehicle identification card or without displaying on such vehicle the requisite identification card shall be subject to such penalty as established by N.J.S.A. 39:4-203.
Any motor vehicle parked in a restricted parking space which does not have displayed a certificate for which a special vehicle identification card has been issued pursuant to N.J.S.A. 39:4-206 may be towed therefrom by order of the Police Department. The owner of such vehicle shall be responsible for all towing costs and storage fees in connection with the removal of the vehicle.
