The following terms when used in this article shall be deemed
to mean and include:
Includes garbage, paper, wood and vegetable wastes and other
waste materials which are readily consumed by incineration.
Includes ashes and other articles or substances of waste
other than those included in the definition of "combustible waste
material."
Includes a partnership or a corporation.
The person or persons collecting and removing waste materials
pursuant to a contract with the Village of Farmingdale or as an employee
of the Village.
A.
It shall be the duty of the occupants of all land and buildings within
the Incorporated Village of Farmingdale upon whose premises waste
materials accumulate to place such waste materials upon the curbline
in front of their premises for collection by the Village Collector
at such times as may be designated by the Board of Trustees for the
collection thereof from their particular locality.
B.
No waste materials shall be placed upon the curbline or elsewhere
for collection and removal unless contained, bundled, tied or packed
in the manner hereinafter set forth.
C.
It shall be unlawful for any person putting out waste materials for
removal from any premises used for business or industrial purposes
and located on both sides of Main Street extending from Melville Road
southerly to the southerly boundary line of the Village of Farmingdale
and on both sides of Conklin Street between Laurelton Street and Secatogue
Avenue to place such waste materials in front of the premises visible
from the street for more than seven hours preceding the commencement
of the days designated by the Board of Trustees for the collection
thereof from said premises, and for any person putting out waste materials
for removal from said premises to permit such waste materials to remain
at the curbline or in front of said premises visible from the street
for a period of more than seven hours preceding the actual collection
thereof, whether such collection is made by the Village Collector
or by any other person.

D.
Notwithstanding
anything to the contrary herein, in certain commercial or business
districts, the Board of Trustees may designate areas for placement
for waste, trash and other refuse. In such cases, the Board of Trustees
may prohibit commercial occupants or owners from placing trash in
street containers or in containers left at the curbline.

All combustible and incombustible waste materials shall, except
as hereinafter expressly provided, be placed in proper watertight
metal containers which shall be kept covered with metal covers and
maintained in a sanitary condition by periodic cleansing. Each of
such containers when filled shall weigh not more than 100 pounds and
shall have a capacity not exceeding 30 gallons. Combustible and incombustible
waste materials must be placed in separate containers, and no incombustible
waste material shall be placed in a container in which there is combustible
waste material. All waste materials, other than garbage and ashes,
which cannot readily be deposited in a metal container may be placed
in boxes or receptacles securely enclosed or, if not placed in such
boxes or receptacles, must be securely bundled, tied and packed so
as to prevent scattering. Each of such boxes, receptacles or bundles
shall contain refuse weighing no more than 50 pounds. All paper cartons
not filled with waste materials shall be broken or folded up in compact
masses and securely tied. Not more than five containers shall be put
out for removal at one time.

All waste materials accumulated or stored upon any premises
used for commercial or industrial purposes or multifamily dwelling
uses within the Village of Farmingdale shall be stored or accumulated
in secure watertight containers which shall be kept closed and maintained
in a sanitary condition by periodic cleansing.
It shall be unlawful for any person putting out wastes for removal
to permit the containers thereof to remain at the curbline or in front
of said premises visible from the street for more than eight hours
after the collection shall have been made. All waste materials which
have not been removed by the Village Collector because of the failure
of the person putting out such waste material to comply with any provisions
of this article must be removed from the curbline and from the front
of said premises visible from the street within eight hours thereafter.
All accumulations of waste materials resulting from the failure
of any person to comply with any provisions of this article and any
waste building materials shall be removed by such person at his or
her expense.
It shall not be lawful for any person to take, remove, collect
or in any manner interfere with or disturb any waste materials deposited
outside of any dwelling, business place or other premises in the Village
of Farmingdale which have been set out for the purpose of having the
same collected and removed by the Village Collector.

A.
It shall be unlawful for any person to collect or remove combustible
or incombustible waste materials for hire from any place or places
within the Incorporated Village of Farmingdale without first having
obtained a permit therefor for each vehicle used in such collection
or removal and without having such permit in force and effect.
B.
Such permit may be issued by the Board of Trustees of the Incorporated
Village of Farmingdale after written application therefor filed with
the Village Clerk-Treasurer, specifying the name, age and address
of the applicant, the character of the equipment to be employed by
him and such other information and proof, including satisfactory proof
of good character, as may be required by the Board of Trustees.
C.
Such permit shall be revocable by the Board of Trustees at any time
upon proof that such permittee is violating any of the provisions
of this article or any other ordinance of the Incorporated Village
of Farmingdale.
D.
The permit fee for each vehicle so permitted shall be set from time
to time by resolution of the Board of Trustees, with a schedule of
such fees to be maintained by the Village Clerk-Treasurer, and said
permit period shall commence August 1 in each year.

E.
Such permit shall be posted in a conspicuous place in such vehicle,
and the failure to have such permit posted as aforesaid shall be presumptive
evidence that such vehicle has no permit under the provisions of this
article.
F.
The term "person" as used herein shall mean and include a natural
person, corporation, partnership or association.

Any person who obtains a permit to collect or remove waste materials for hire pursuant to § 469-8 hereof shall collect such waste materials only during the following times:

Any person violating this article or any provisions thereof
shall be punished by a fine not in excess of $250 or 15 days' imprisonment,
or both, and each violation thereof shall constitute a violation pursuant
to the Penal Law of the State of New York.
