The City of Nanticoke Technical Civil Service Commission is
hereby established by the City Council.
The Chairperson or, in his or her absence, the Vice Chairperson
shall preside at all meetings and hearings of the Commission, decide
all points of order of procedure, and perform any duties required
by law or this chapter.
The Technical Civil Service Commission shall appoint a Secretary
and prescribe his or her duties. He or she shall be subject to removal
at any time by the Commission. The Secretary shall carry on, at the
direction of the Commission, all official correspondence of the Commission,
send out all notices required by law and these rules of procedure,
keep a record of each examination or other official action of the
Commission, and perform all other duties required by law, by these
rules and by the Commission.
The board shall organize for the purpose of transacting all
business immediately after first appointments and, from time to time
thereafter, as new appointments to such board are made. Except for
the biennial organizational meeting, all meetings shall be held either
at the call of the Chairperson or at the call of two members of the
Commission. At least 24 hours' notification of each meeting shall
be given each member. The Commission shall have the discretion to
determine whether meetings shall be open to the public when not specifically
regulated by existing law.
A quorum shall consist of two members, and all actions of the
Commission shall have the concurrence of at least two members.
The order of business of all meetings of the Commission shall
be as follows:

F. Communications and reports.
The Secretary shall keep minutes of the Commission's proceedings
showing the vote of each member upon each question, or if absent or
failing to vote, indicating such fact. The Secretary shall maintain
with the minutes copies of all correspondence, communications and
reports. Copies of all minutes and notices shall be provided to the
City Clerk.
Any member of the Technical Civil Service Commission, once qualified
and appointed, may be removed from office for malfeasance, misfeasance
or nonfeasance in office or for other just cause by a majority vote
of the City Council aforesaid taken after the member has received
15 days' advance notice of the intent to take such a vote. A
hearing shall be held in connection with the vote if the member shall
request it in writing. Any appointment to fill a vacancy created by
removal shall be only for the unexpired term.
The Commission shall elect its own Chairman, Vice Chairman and
Secretary. Officers shall serve annual terms and may succeed themselves.
The Commission may make and alter bylaws and rules and regulations
to govern its procedures consistent with the ordinances of the City
of Nanticoke and the laws of the Commonwealth of Pennsylvania.
The Commission shall have the powers and duties as established
by Article 44 of the Third Class City Code, as amended from time to
time. Consistent with the Third Class City Code, no person or persons
may be appointed to any position whatever in the Engineering Department
or Electrical Department, except as otherwise provided by law, or
in the position of Building Inspector or as health officers or sanitarians
other than registered physicians, or as sanitary policemen or inspectors
of the Health Department, without having first passed all the examinations
hereinafter provided for and having been appointed in the manner and
according to the terms and provisions and conditions of this chapter
and the Third Class City Code.
The City Council may appropriate funds on an annual basis to
support activities of the Commission. Expenditures recommended by
the Commission shall be on forms provided by the City and shall conform
to the City budget as well as appropriate City ordinances and resolutions
and state and federal laws governing purchasing and expenditures.
The Commission shall keep a full record of its business and
shall annually make a written report by April 1 of each year of its
activities to said City Council. Interim reports may be made as often
as may be necessary or as requested by the City Council.
