The City of Nanticoke Technical Civil Service Commission is hereby established by the City Council.
A. 
The Commission shall consist of three citizens elected by City Council to staggered four-year terms. All of the members of the Technical Civil Service Commission shall be residents of the City of Nanticoke, Luzerne County, Pennsylvania, at the time of appointment and for the term of the appointment. No City officer, employee or official shall be eligible for appointment to the Commission.

Upon adoption of this chapter, City Council shall elect to the Commission one person to serve for two years, one person to serve for three years, and one person to serve for four years. Upon the expiration of the term of any member of the Commission, one person shall be elected by the City Council to serve upon said board for the term of four years. If any vacancies occur, they shall be filled by the City Council for the unexpired term. Each of said members, before entering upon the duties of his office, shall take and subscribe to the oath of office prescribed by this chapter and file the same, duly certified by the officer administering it, with the City Clerk. No salary or other compensation shall be paid to any member of the board.
The Chairperson or, in his or her absence, the Vice Chairperson shall preside at all meetings and hearings of the Commission, decide all points of order of procedure, and perform any duties required by law or this chapter.
The Technical Civil Service Commission shall appoint a Secretary and prescribe his or her duties. He or she shall be subject to removal at any time by the Commission. The Secretary shall carry on, at the direction of the Commission, all official correspondence of the Commission, send out all notices required by law and these rules of procedure, keep a record of each examination or other official action of the Commission, and perform all other duties required by law, by these rules and by the Commission.
The board shall organize for the purpose of transacting all business immediately after first appointments and, from time to time thereafter, as new appointments to such board are made. Except for the biennial organizational meeting, all meetings shall be held either at the call of the Chairperson or at the call of two members of the Commission. At least 24 hours' notification of each meeting shall be given each member. The Commission shall have the discretion to determine whether meetings shall be open to the public when not specifically regulated by existing law.
A quorum shall consist of two members, and all actions of the Commission shall have the concurrence of at least two members.
The order of business of all meetings of the Commission shall be as follows:

Approval of minutes of previous meeting.
C. 
Unfinished business.
D. 
Hearing cases.
E. 
New business.
F. 
Communications and reports.
The Secretary shall keep minutes of the Commission's proceedings showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact. The Secretary shall maintain with the minutes copies of all correspondence, communications and reports. Copies of all minutes and notices shall be provided to the City Clerk.
Any member of the Technical Civil Service Commission, once qualified and appointed, may be removed from office for malfeasance, misfeasance or nonfeasance in office or for other just cause by a majority vote of the City Council aforesaid taken after the member has received 15 days' advance notice of the intent to take such a vote. A hearing shall be held in connection with the vote if the member shall request it in writing. Any appointment to fill a vacancy created by removal shall be only for the unexpired term.
The Commission shall elect its own Chairman, Vice Chairman and Secretary. Officers shall serve annual terms and may succeed themselves. The Commission may make and alter bylaws and rules and regulations to govern its procedures consistent with the ordinances of the City of Nanticoke and the laws of the Commonwealth of Pennsylvania.
The Commission shall have the powers and duties as established by Article 44 of the Third Class City Code, as amended from time to time. Consistent with the Third Class City Code, no person or persons may be appointed to any position whatever in the Engineering Department or Electrical Department, except as otherwise provided by law, or in the position of Building Inspector or as health officers or sanitarians other than registered physicians, or as sanitary policemen or inspectors of the Health Department, without having first passed all the examinations hereinafter provided for and having been appointed in the manner and according to the terms and provisions and conditions of this chapter and the Third Class City Code.
The City Council may appropriate funds on an annual basis to support activities of the Commission. Expenditures recommended by the Commission shall be on forms provided by the City and shall conform to the City budget as well as appropriate City ordinances and resolutions and state and federal laws governing purchasing and expenditures.
The Commission shall keep a full record of its business and shall annually make a written report by April 1 of each year of its activities to said City Council. Interim reports may be made as often as may be necessary or as requested by the City Council.
